To Whom It May Concern,

This is James Avery, resident 1840 Mason Mill Road.

I came in roughly seven days ago and filled out an Open Request Form seeking ...ALL... informations possible (Emails, Memorandums, Service Request/Complaints, Court Hearings, etc., etc., etc.) on file with DeKalb County Code Enforcement Division relating to inappropriate signage 1840 Mason MIll Road.  Understanding this would take a good bit of time putting together, I then left with the understanding that someone would be calling me back with an estimated cost.

I have yet to hear from anyone?

And it is my understanding that this information should have been provided to me within 3 business days?

Please advise.

It's appearing already that the same trouble I'm having with getting copies of my file with Emory Police, DeKalb Crisis Mobile Unit, Georgia Regional Hospital, Law Office of  Public Defender, as well as meetings with various elected officials, and even pastors of various churches, the same trouble I'm going to be having with DeKalb County Code Enforcement?

Thank you for your request to review and obtain copies of county records. Your request for “emails, memorandums, etc. relative to 1840 Mason Mill Rd., code violations, court hearings & inspections while on probation since October 22, 2012”, was received on May 3, 2017. We have begun to process the request and will make the documents available upon receipt of payment. 

As provided in O.C.G.A. §50-18-71, the only charges will be $14.34 per hour (no charge for the first 15 minutes) to cover the administrative cost of assisting you with your request plus a charge for copies of records. Prepayment is required for any request with an estimated cost of $25.00 or more. If prepayment applies, document copying will not be done until after payment is received. If estimated cost is under $25.00, payment is due when collection of documents and any copying is done. 

The County and its officials and departments do not produce documents or records that are protected by the attorney-client privilege or the attorney work product doctrine under Georgia or federal law or that are otherwise exempt from production under the Georgia Open Records Act. The County expressly reserves and does not waive any statutory exemptions from disclosure provided by O.C.G.A. §50-18-72, et seq. and other applicable laws.

Thank you for replying back to me.

I have read your response to my Open Records Request.  

And I do understand that I'm expected to pay for copies of these document  as well as administrative cost for assisting me with this request.  

Correct me if I'm wrong, but your response reads as if you are expecting a prepayment now?

Before anything else is done?

If correct, just need to know the amount?

Or do you need more time gathering the documents before you have a cost estimate?

If so,  roughly when can I expect to hear from you with this cost estimate?

Pleasure meeting you this afternoon when I dropped in at DeKalb County Code Enforcement Headquarters picking up copy of my file.   

However I was very disappointed seeing there were only thirteen sheets of paper in manila envelope handed to me this afternoon; seven of them being copies of email exchange  between me and you regarding my request for copies of my file with DeKalb Count Code Enforcement from October 22, 2012 through present date.

Sentencing:

1. 1,000 dollars fine per citation (10 citations) totaling 10,000 dollars.
2. Avery to time on probation (60 months)
3. Avery will serve 1 week in jail beginning immediately
4. Once released, Mr. Avery has 30 days to clean property and property to be free of code violations
S. If Mr. Avery doesn't comply and is found to violate the Judges sentencing; Mr. Avery will spend 2 weeks in Jail
6. Once released, Mr. Avery has 30 days to clean property. f-
7. If Mr. Avery doesn't comply, Avery will spend 30 days in Jail.
8. Upon release he has 30 days to clean property.
9. If Mr. Avery doesn't comply, Avery will spend 60 days in Jail.
10. Upon release he has 30 days to clean property.
11. If Mr. Avery doesn't comply, Avery will spend the balance of time in Jail.
12. Every 6 months defendant is in compliance, 1,000 dollars will be suspended.

As I understand from Solicitor Getz,

The probation department will monitor the order/sentencing of Judge McCoyd; this will relieve code enforcement from
this task. However, if a new compliant is lodged against Avery, then the code enforcement will have to inspect. Getz
informed the gallery of on lookers/neighbors of this monitoring process.

FYI Tonza,

While Officer Dewitt and I were re-inspecting 1840 Mason Mill Rd (Avery, James owner) for court scheduled on January
20th 2017 at 1 pm, there were MEDIA ATTENTION AND RECORDING of our activity. I wasn't able to identify the t.V.
station involved however, we did not speak to them/him at all.

Mr. Avery went into the house to retrieve all his signs and threw the signs in the yard. Only photos and measurements
taken at this time.

Except for pictures Officer Housworth and Officer Dewitt took the day of January 19, 2017, the above information is all that I've received.

Recently sent you an email questioning the records released to me May 18th, 2017.

When considering how quickly you've responded to earlier emails of mine requesting copies of all records possible regarding inappropriate signage 1840 Mason Mill Road on file with DeKalb County Code Enforcement dating back to October 22, 2012, thought it best I follow up with this email making sure you have received this email?   Inquire as to whether or not I'm to be expecting a response from DeKalb County Code Enforcement?

I've also sent emails to Supervisor Silvers,  Officer Lorena, and Officer Housworth during this time frame requesting  copies of these records.  It would be nice seeing copies of these emails and their response (lack of response) among these records as well; the same as emails from John Bugge and Patrick Noonan concurring along with George R. Gary, Sr. ThD and his wife Janet Claire Segers Gary had been save to my file earlier copies requested from DeKalb County Code Enforcement..?
