Citations allege violations of code sections: 21-13, 27-1583 (A)(2), 27-1584(C)(1)
Sec. 21-13. - Restrictions in residential zoning districts.
The following regulations shall pertain to lots located in single family residential zoning districts and R-DT, TND, RA5, RA8, RCH, MHP, NCD and RM zoning districts:
(1)
Lots used for residential purposes other than for apartments, condominium, mobile home, or townhouse developments shall not have an aggregate sign area greater than twenty-four (24) square feet per lot. Flags and banners shall not be included in the calculation of aggregate sign area. Subdivision and entrance signs shall not be included in the calculation of aggregate sign area;
Sec. 27-1583. - Temporary outdoor seasonal activities.
Temporary outdoor seasonal activities include the sale of retail merchandise associated only with recognized seasonal and federal holidays, the sale of farm produce, Mother's Day, Easter, and Valentine's Day, subject to the following regulations:
(a)
Use regulations.
(1)
A special administrative permit shall be required, for all temporary outdoor seasonal activities.
(2)
Events or sales of retail merchandise not customarily associated with seasonal or federal holidays or farm produce is prohibited.
Sec. 27-1584. - Temporary outdoor retail sales displays.
Temporary outdoor retail sales displays and related outdoor storage activities include the exhibition or representation of goods, merchandise, materials, or other items sold or bought at a retail establishment in which the items are displayed or sold outside the confines of a wholly enclosed building, and which are associated with the principal use of an existing business. Temporary outdoor retail sales displays shall not include events for which no business license is required (e.g. cookie sales). Temporary outdoor retail sales displays shall be subject to the following regulations.
(c)
Setback and display requirements.
(1)
All temporary outdoor retail sales display activities, including installation or erection of associated temporary display and sales structures, and stand-alone merchandise, display tables, or display racks, must be set back at least ten (10) feet from a county or state right-of-way.

I do not remember if we had discussed any part of my pretrial conversation with Solicitor Graham that led to her informing Judge McCord that she was uncomfortable proceeding forward with the court hearing.
As I am already isolated due to a hearing impairment and losing even more as I age...
As I have recently become even more isolated due to having lost most of my vision my right eye with a 15% chance same happening with other eye...
It's important that you understand why any outcome involving any kind of probation in addition, or not, to a fine is unacceptable to me.
And this is going to require a decent amount of time.

p.s. DeKalb County Mobile Crisis Unit has paid me another visit this passed Monday. This makes the ninth time they have come out to my house uninvited, unannounced, unwelcomed as they are a complete waste of both our times. I've even been unable getting copies of any of these records/reports associated with these visits because they...supposedly... are not considered legit medical records. Considering it was at the end of the third visit that a Chemical Nurse Specialist Lana Chase informed me of the reason for these visits being a concern that I might be a homicidal/suicidal risk, maybe you will be able understanding why I have now ingrained the... potential... for a suicide into my story?
I'm not saying that I plan on hanging myself, only that I'm now able understanding why someone would.

He's indicated that he will likely be moving your September 13th hearing to the downtown Decatur courthouse where he suspects they have hearing assistance devices. Myself and other folks within my office are working to make sure that you'll be able to hear the proceedings wherever they end up being. I will let you know for sure which location we will be at on the 13th.
As far as meeting to discuss your defense, what is your availability for next week?

Curious now as to who will be paying for this "formal" mental health evaluation? Far as I know, Georgia Regional Hospital still has a lien against my home for when I was involuntarily committed (with the help of my Arkansan mother and sister) for five weeks back in August/September of 2011? In addition to these nine unannounced/unwelcomed visits, so far, to my home by DeKalb County's Mobile Crisis Unit, are we possibly admitting these evaluations to be flawed/inadequate? I'm still extremely unhappy with how DeKalb County (most especially Emory) having taken advantage of a self-avowed practicing homosexual's complicated relationship between him and his eighty year old rural Arkansan mother.

It didn't help any, either, that all my mother had to do accomplishing this, was, getting my big sister of seven years to stop playing tennis long enough driving her across several states to Atlanta.

Plus, there definitely should be less history needed bringing them up to date about my situation. In fact, possible we may even be able skipping S.ubjective O.bjective going straight to A.ccessment; maybe even straight to P.lan?
Not only should this save the State of Georgia some money; even willing paying for it out of my own pockets..

So you may need to come to our main office located at 320 Church Street in downtown Decatur. I will ask if the interview can be conducted at Care and Counseling Center of Georgia, but I am uncertain if that is a possibility. Do you currently receive treatment there?
2. In terms of payment, I believe that since the Judge is requesting it, the evaluation is paid for by the state.
3. Ordinarily the cost for the services of the Public Defender would be your obligation. However, I believe that the Judge appointed us to your case, is that correct? If so, then I would certainly request that the $50 application fee (which would be your only costs for our services) be waived. I would make that request at the conclusion of your case, whenever that may be.

How is it decided...WHO...will be doing this evaluation?
As my signs have a strong religious theme to them, I am mainly interested in Care and Counseling Center of Georgia because it's actually "Pastoral" Care and Counseling Center of Georgia. Remember the eighty-five year old black man with a blower on top of the house directly across the street from my house I had mentioned to you during our phone conversation? I spent 2 1/2 weeks in DeKalb County Jail all because of an email not only nothing but words but words to be true having violated a restraining order the owners of that house had against me.

Received three more citations from Officer Housworth, accompanied by Officer Flemmings, this afternoon. Believe this now makes for a total of seventeen citations.
However, one of these three citations is for having seventeen signs over the four I'm allowed when assuming each sign is six square feet which is the maximum sign size allowed in residential neighborhoods. Officer Housworth didn't seem to know for sure whether this counts as just one citation or seventeen citations?

The other day an old man stops his car in front of my house as I was putting out my signs for the day and says to me: "What you do with those other people I do not care; that's your business. But why drag the Jews into this? What they have to do with any of this!"
Standing in the street beside his car, I said to him: "Those...SIGNS... are their opinions. Those ...SIGNS... are my attempts trying to show you the difference between...THEIR...signs and...MINE."
And this is where he angrily mumbles something, something I could not make out but fairly certain others probably could have, as he begins driving off.
This act having set off multiple triggers, I yelled after him: "IT'S NOT YOUR LAND! YOU MIGHT AS WELL SHOVE THAT THOUGHT UP YOUR CHOSEN ASS!"
The next day as I'm politicking from sidewalk front of my home, I'd managed baiting into a brief discussion, about my signs, two women as they were walking through my property on this sidewalk. Although not recognizing either of these two women as any living Mason MIll neighborhood, assuming they were Mason Mill neighbors of mine, I said to them: "Those signs of mine with people holding signs are my attempts showing the difference between their signs from mine."
Then I pointed to a signs close to where we were standing that reads, EVERYONE NEEDS A CHURCH: LETS CARPOOL, accompanied with a picture of Earth wrapped up in barbwire.
"This sign for example! The neighborhood I'm wanting to believe I live in extends halfway around the world in all four directions to a same point located somewhere in the Indian Ocean. We are already carpooling! A person who thinks like this is going to think differently from a person just thinking of Mason Mill as his/her neighborhood."
"One sign up there was really offensive!" said one of these two ladies as she points in the direction of signs place near sidewalk other side of my property from where we were standing.
"Oh really! Which one?" I asked.
"The one that says, 'GOD HATES JEWS.'"
"What about the one that says,'GOD HATES FAGS,'" I then asked? "It's possible to be both you know?"
These two then appearing to have nothing more to say, I followed up with, "Not only am I gay, I'm Atheist as well. I've been doing this too long for this neighborhood to have no good excuse for not already knowing this."

Last Thursday, early afternoon, I'd walked down to the convenient store on the corner of Mason Mill and Clairmont. I returned finding my "FUCK THE LORAX" sign had gone missing.
My question is:
Because someone would have been able grabbing this sign without stepping off the sidewalk, in other words, within ten feet of their right-of-way while trespassing through my property with their opinion of me; does this, or does this not still count as petty larceny?
Also, had the removal of this sign from my property taken place same day, but after having already been written up for this sign being in violation(s) of DeKalb County Code Ordinances; am I still held accountable for this same sign having violated DeKalb County Code Ordinances?

Yet, an email of mine violating a restraining order against me by former neighbors of mine once living in the house directly across the street from mine landed me on the fifth floor (felony floor) of DeKalb County Jail; aggravated stalking.

It is my understanding that I also have three days worth of citations waiting my signature on those days where we missed each other for one reason or another?
I am more than willing (actually prefer) making arrangement meeting with you and/or Officer Armstrong at Code Division Headquarters getting these signatures out of the way; rather than wait till your next set of citations.

2) Also the court needs to be informed that my Arkansan family are not even aware, as far as I know, of anything that has transpired here in Atlanta since March of 2014 when I began refusing all contact with my Mother; even though everything (court hearings, progressive hearing loss, acute blindness right eye, relapse of the crystal meths addiction, suspected pituitary 'macroadenoma' mass, available cash) posted up to my blogs. 3) As far as me being able assisting counsel in locating and examining relevant witnesses, do you have any suggestion as to whom you believe might be relevant witnesses based on what you've heard from me so far? ORDER FOR MENTAL EVALUATION REGARDING:
COMPETENCY TO STAND TRIAL
WHEREAS, the mental competency of the above defendant has been called into question and evidence presented in the matter, and this Court has found that it is appropriate for an evaluation to be conducted at public expense:
It is hereby ordered that the Department of Human Resources (or the Forensic Psychiatry Services) conduct an evaluation of said Defendant, provide treatment of the defendant, if appropriate, and provide this court a report of the diagnosis, prognosis and its findings with respect to:
Competency to Stand Trial: Whether the accused is capable of understanding the nature and object of the proceedings against him; and whether the accused is capable of assisting counsel in his own defense. In determining the ability to assist counsel, the Department of Human Resources is to consider and report on the following factors as put forth by the Georgia Supreme Court in Sims v. State, 2005 WL 1320318 (June 6, 2005):
1. Can the defendant recall and relate facts pertaining to his actions and whereabouts at certain times;
2. Is he able to assist counsel in locating and examining relevant witnesses;
3. Is he able to maintain a consistent defense;
4. Is he able to listen to the testimony of witnesses and inform his lawyer of any distortions or misstatements;
5. Does he have the ability to make simple decisions in response to well-explained alternatives;
6. If necessary to defense strategy, is he capable of testifying in his own defense;
7. To what extent, if any, is his mental condition apt to deteriorate under stress of trial.
IT IS FURTHER ORDERED that the examining facility/personnel shall have access to all past medical records and mental health records of defendant. The examining facility/personnel shall have access to any other pertinent collateral data, including but not limited to collateral interviews with family members.

Yes, yes, yes I do so very much want representation by The Law Office of Public Defender DeKalb County. Just that very act of our Honorable Judge Matthew McCoyd having assigned a Public Defender to my case (even though I did not qualify because of owning one hundred percent equity in my home) was actually a "GOD-SEND". I did try explaining to our previous Assistant Solicitor-General Stephanie Graham why I wasn't already having a lawyer representing me during our second hallway pre-trial hearing as Officer Housworth listened in on us (and I believe it was this pre-trial hearing Officer Lorena eventually walked out into the hallway joining us); but Assistant Solicitor-General Stephanie Graham was hearing (?) none of it.
Let's be honest with ourselves; before I'm needing worrying about our Honorable Judge Matthew McCoyd's final judgement, I'm needing getting past yours first.
The attorney-client privilege is still my call.
And it is my intention/attempt keeping the "public" informed every step of the way.
Just keep your advice to me legal and there should be no problems; for you at least anyway.

As long as it took the Courts getting this notice in the mail to me, God I hope we're not waiting on even more mail from the Courts as to when and where I'm supposed to show up for this mental evaluation.

There is much more to the story if others werent so quick to pass judgement and in turn the delivery of message could also use some finesse at the end of the day anytime dialogue is presented that is considered taboo the instict is to tar & feather the messenger FF a decade and the people we want to villanize for having started said dialogue are appreciated and given some credit for the forward motion they helped create...as for what I can say is that there are some 30 maybe 31 citations that have been issued and this man still waits daily to hear from a court appointed public defender that at best has presented a bias or at very least represents an inherent conflict of interest as this man looks to have anyone champion even one idea he wants to share. Instead everyone jokes and can't seem to understand his response to all of this is to hold up a mirror and for everyone to keep living blissfully ignorant.

This status hearing will be just that--a formal on-the-record discussion of the status of your case. This hearing
will not require any action from you, other than being present.

I 'm finding it odd that representation by Law Office of Public Defender DeKalb County only cost fifty dollars for anyone who qualifies; while at the same time, Law Office of Public Defender DeKalb County located in a parking lot charging ten dollars for any parking over thirty minutes..? If I wrote Law Office of Public Defender DeKalb County a check for one hundred and fifty dollars, will I be able requesting representation by three public defenders?
I'm currently wanting Marian Maloney and Lauren Stadalius joining our team. As it is not entirely my fault I know of them, they are already an important part of my (our) story.
Though the main purpose of the Priests Rape Boys website is to criticize Catholicism, the WBC also criticizes several mainline Protestant churches on the website, including Methodists, Presbyterians, Lutherans, Anglicans, and Baptists. The WBC states that

really don't matter much, at this point. My sole job is to provide you with sound legal advice, to protect your rights as my client, and to provide the best legal defense possible. My role as your attorney requires that I be a disinterested (not uninterested) party.
I would be more than happy to give you my assessment of your case from a legal standpoint when we meet.
You also asked about Ms. Stadalius and Ms. Maloney also being able to represent you as part of your legal team. Unfortunately, Ms. Maloney now works in another division of our office, and will not be able to assist with your matter. Ms. Stadalius will also soon be transferring to another division of the office and unfortunately she will not be available to assist either.
You also inquired about having Shirley Phelps-Roper assist, as legal counsel I believe, in your case. Your status hearing has been moved to January 3, 2017. We need to meet in person
to discuss the case and the information that was exchanged at this brief meeting today.

My personal thoughts and opinions regarding this matter
really don't matter much, at this point. My sole job is to provide you with sound legal advice, to protect your rights as my client, and to provide the best legal defense possible. My role as your attorney requires that I be a disinterested (not uninterested) party.
I would be more than happy to give you my assessment of your case from a legal standpoint when we meet.
You also asked about Ms. Stadalius and Ms. Maloney also being able to represent you as part of your legal team. Unfortunately, Ms. Maloney now works in another division of our office, and will not be able to assist with your matter. Ms. Stadalius will also soon be transferring to another division of the office and unfortunately she will not be available to assist either.
You also inquired about having Shirley Phelps-Roper assist, as legal counsel I believe, in your case. You are certainly welcome to reach out to her to inquire as to whether she would be interested in representing you. But because you are represented by our office, we (meaning the Public Defender's Office) wouldn't seek assistance from outside counsel for your case.
You also asked about getting a recording of the court proceedings. All courtroom proceedings are recorded so we can definitely get a recording of the status hearing, and I can search to see if we can obtain a recording of your previous court appearances. I am not sure if the court will have a court reporter present in court on January 3. I can request one on your behalf. I will let you know the Judge's response.

May I ask, what were the personal opinions of mine having put us in this awkward position regarding my rights (or?not) waiving the "attorney-client" privilege? Or a different way of asking the same question; are there any opinions of mine we are in agreement? If others are unable successfully defending their viewpoints, then only they know how best to correct this problem.

Can't help but feel as if my legs are being broken, although by women in general, most especially by those with or having had successful careers..
My experiences of late do have me becoming somewhat understanding (sympathetic) with what may be part of the driving force behind the ALT-RIGHT movement; even those of fathers having turned their guns on their own families before themselves. And this is an example of what I'm wanting to believe is my talent; Principle of Charity.
In philosophy and rhetoric, the principle of charity requires interpreting a speaker's statements to be rational and, in the case of any argument, considering its best, strongest possible interpretation. In its narrowest sense, the goal of this methodological principle is to avoid attributing irrationality, logical fallacies or falsehoods to the others' statements, when a coherent, rational interpretation of the statements is available. According to Simon Blackburn "it constrains the interpreter to maximize the truth or rationality in the subject's sayings."
Seriously, try putting more thoughts into questions having asked of you previous email(s), for example, are there any opinions of mine where we are in agreement?

Hello Mrs. Gibbs,
Just wanting to verify that I'm understanding correctly the updates about my case relayed to me by both you and Public Defender Meredith McCarrey during our meeting this past Monday afternoon December 19, 2016 at Law Office of Public Defender DeKalb County.
- There will be no mental health/competency evaluation pre-trial because Georgia Regional Hospital refused/declined accepting the case.
- That Court Hearing scheduled for January 3, 2016 will actually be the trial; not just a case status hearing.
If we have a trial coming up this January 3rd, we have a lot of ground needing to cover before you are able effectively representing me. Again, this case isn't so much about Freedom of Speech as much as it is about Needing a Right to be Heard.
Also, I'm curious now about Mrs. McCarrey. Because she already knew from a neighbor of mine about me being banned from NEXTDOOR.COM, certainly do believe I've a right knowing just what else she's been made aware about me?
So, what is the next step? Please advise.

Regarding the citations I'm continuing to incur while we're waiting on this pending trial, I'm assuming DeKalb County's Office of Solicitor-General will already be asking our Honorable Judge Matthew McCoyd, again, for a cease and desist order.
cease and desist order
n. an order of a court or government agency to a person, business or organization to stop doing something upon a strong showing that the activity is harmful and/or contrary to law. The order may be permanent or hold until a final judicial determination of legality occurs. In many instances the activity is believed to cause irreparable damage such as receipt of funds illegally, felling of timber contrary to regulation, selling of shares of stock without a proper permit, or oil drilling which would damage the ecology.
Seems to me this is just a different way of saying the same thing..?
So, may I ask what it is you are hoping to accomplish other than repeating Public Defender Marian Maloney's success (with her former coach, our Honorable Judge Matthew McCoyd, from her days with the Emory Mock Trial Society as a law student) at having blocked our former Assistant Solicitor-General Stephanie Graham's first attempt at a Cease and Desist Order?

I will bring up the issue of citations that you are accruing in the interim while this case is still pending. And I imagine that the judge will give any other insights he may want to share.
This hearing is truly just a status update--a chance for all parties to share information and let the court know their positions at this point. Also, the attorney that you met with on the 19th, who will also be there at the status hearing, her name is Ingrid McGaughey. Meredith McCarrey is not representing you on this case.

I had already told myself before the Supreme Court issued their ruling with the Snyder vs. Phelps case, that I was going to be completely okay with a ruling in your favor; although a FAG myself. Shirley Lynn Phelps-Roper (born Shirley Lynn Phelps, October 31, 1957) is an American lawyer and political activist. She is best known as the former spokesperson of the Westboro Baptist Church of Topeka, Kansas, an organization known for its highly publicized homophobic public protests conducted under the slogan "God Hates Fags." Phelps has been highly criticized and taunted by the media for her perceivedreligious fanaticism and poor parenting.

Phelps-Roper and the church have received media coverage for the group's aggressive preaching and controversial campaigns such as the picketing the funerals of AIDS victims with signs such as "God hates fags" and funeral processions for American soldiers killed in combat.
In 2014 it was reported that Phelps-Roper's duties as spokesperson for the Westboro Church had been reduced, and her authority transferred to an all-male board of elders.
Although I label myself a radical atheist as an adult, I'm okay with being labeled a Methodist Fag due to my first eighteen years raised with the help of First United Methodist Church of Prescott, Arkansas. As we must first be introduced to God before being aware of God, I have only recently realized that I have always been and forever always will be Methodist til the day I die; no less than Jesus ever stopped being a Jew.
Absolutely refuse being labeled a Christian as it tells you absolutely nothing about anyone.
Though the main purpose of the Priests Rape Boys website is to criticize Catholicism, the WBC also criticizes several mainline Protestant churches on the website, including Methodists, Presbyterians, Lutherans, Anglicans, and Baptists. The WBC states that
...their preachers have shirked their responsibility to tell people the truth about sin, and instead lie to them about what the Lord their God doth require of them. If these lying, false prophets told people the truth about what God says regarding those who suffer sin upon their neighbor (Lev. 19:17–18), there wouldn't be any butts in the seats when the plate got passed. These preachers are not preachers of righteousness, they are teachers having itching ears (2Tim 4:3), and they absolutely count on the abysmal bible illiteracy of their parishioners ... "Priests rape boys" is indeed an air-tight, three word case against all of the mainline "christian" churches – their preachers and members, without exception. They are all going to Hell!
Although I do not completely agree with the over generalization with the above statement by your church, you did hit it on the nose with our Methodist. They do have "itching ears."
Because of a feud between me and members of Glenn Memorial United Methodist Church located on Emory Campus, I have recently conceptualized my suicide based on my theological orientation. Was wondering, would you and your church be interested in pre-emptively picketing the funeral of TAO~g(SIMPLY JIM: METHODIST FAG THE POLITICAL CATALYST)d~OG at his home.

I’ll tender the remaining tickets for NP prior to trial / plea. If there’s a trial, I expect to have Ofc. Houseworth testify that he went to the house on the dates & observed the signs, measured them et c., & determined that there was signage in excess of the sq. footage regulation & tender the photos from the dates in question. I’m not going to have any of the neighborhood people testify as to signage or anything else at trial. They may want to be heard on sentence but I’ve pretty well told them that I expect, if the judge finds Mr. Avery guilty, that the sentence will be geared towards compliance. Don’t exceed the sq. footage for signage, as we’ve discussed.

Yes I am willing to cover the cost of having a case reporter present at upcoming court hearing Friday January 20th. Going to be interesting seeing how this works out.
Right now I can barely talk due to increased intensity of these sidewalk rants of mine past few days. Just the thought that this coming Friday's court hearing will be ending these activities without any real discussions of the events leading up to these activities, enough, motivating me to just go for it. The case reporter I'm thinking might help eliminate the tendency of others being so easily dismissive of anything I'm able (unable) saying within this court hearing. At least provide me with proof able showing anyone willing to read it. Otherwise a waste of time.
Jokingly, I refer to these sidewalk rants as my bipolar medication. Not only is it a whole lot cheaper than the $20,000.00 per year out of pocket cost for just one of two medicines Georgia Regional Hospital was just wanting to try me on first, a drug that may take several months before I started thinking clearer, without even being able telling what were we expecting to happen when I started thinking clearer on this medicine, without being able telling me how then would we know when it did start working or even how we go about deciding when we should try somethings else. Not even what it was making them thinking I wasn't thinking clearly to begin. How could they, when, they never even sat down and talked with after I came down from that two weeks duration of inconsolable rage having been so easily involuntarily committed by my mother and sister from Arkansas.
And I can't help but find this interesting.
Although I know that the rest of you do not need to worry about me going on a homicidal killing spree, YOU ... can't be certain about that. I've also been strongly hinting at the possibility of a suicide. You should see all the people waving good-bye as they drive by. Silence and good-bye. So textbook classic.
I'm definitely able, now, understanding why others do; both homicidal and suicidal. Even if this neighborhood successful in getting rid of me, the root cause stays.
Once you are okay with one person dying for your sins so you may live; you're okay with the whole world dying for your sins so you may live. Why should anyone else be any less indifferent.
