I am the interim director of the Georgia Innocence Project.

Thank you very much for your very generous $10,000 donation to the GIP.  We are grateful for your interest in and support of our organization.  

Matt, our recently hired Operations and Communications Manager, told me about your phone conversation with him and his promise that GIP could notify the judge in your case, Judge McCoyd, about your $10,000 contribution.

I'm afraid that Matt was mistaken, and we are unable to make good on that promise. GIP's bylaws, acceptance criteria, and policies prohibit us from getting involved in court cases or communicating to a judge or prosecutor on behalf of someone unless the person is our client. Our case acceptance criteria requires, among other things, we can only accept clients who have been convicted of a serious felony and have finished all of their direct appeals.

Because it appears that you've donated to us with the understanding that we would contact Judge McCoyd on your behalf and because we are unable to do that, we have refunded your $10,000 donation.  It will take 3 to 5 days to be fully refunded back to your credit card. THought you might find the 1987 LSU-SVM graduation pic of me with my Mother, Father, Sister, Two Niece, and Aunt Jeanette interesting.  Thought it unusual that all those on my left had or having  to work while all those on my right still do not.  LIke I told my mother and sister,  although Atheist, at least I'm able pretending that I believe in Purgatory.  In other words, we could pretend that we don't get into heaven until we get Dad through that gate first.  So I deposited the $14,000.00 gift check given to me by my mother to my account, then turned right around donating $10,000.00 of it to GIP.  Both my mother and sister are extremely unhappy about this.  They both are completely unable understanding that it's because of this money we not only let our workaholic father work himself into an early grave that making it possible for them?us not having to work,  it's also this money that's making it harder, rather impossible,getting me who really should be working off and away from this crystal meths addiction of mine.  ANd this is where our less than honorable  Judge Matthew McCoyd is proving  himself to be quite a hypocrite actually.    But apparently I've never going to be able finding anyone backing me up on this observation of mine.

Just remember, whenever speaking with my sister,  just keep up front and center at all time, that she been to San Fransisco, but,  "OH NO!  We didn't...GOOOO...to California!  Just San Francisco!"  And that she still loses the Civil War...EVERY TIME...before the movie is even over!

The purpose of this email is my attempt, even should it prove itself futile as well , informing all MMCA neighbors of mine that we are not done...yet...with these hearings over the inappropriateness of these signs my property 1840 Mason Mill Road; as well as correcting some of the misinformations having read within updates posted to MMCA newsletters that were being passed along to the rest of it's hundreds of its members not having been present at these court hearings; misinformations at best... misleading; misinformations at worst... manipulative/deceptive eliminating consent.

1.  Only in jail for five days.
2.   Another court hearing scheduled Tuesday, January 31, 2017 at 2:00pm Courtroom E Camp Circle Complex.
3.  That this hearing is only Judge McCoyd wanting to clarify the terms of probation.
4.   Unless a mistake, the length of probation has been reduced from 60 months to 6 months.
5.   All probation suspension fees waived.

In need of getting this email out to our MMCA leaders (NEXTDOOR.COM's Mason Mill Neighborhood Leads) as quickly as possible as the sun will soon be rising, going to stop here and send the rest later.  However I'm feeling I must add,  these changes having occurred without any updates both MMCA's Newsletter or Bobby Rasulnia's Petition, I'm DAMNED curious hearing what Our Honorable Judge Matthew McCoyd having to say at this hearing Tuesday afternoon?   What I will be allowed (not allowed) saying at yet another hearing (non-hearing).

State of Judiciary
Chief Justice Harris Hines gave the State of the Judiciary report this week to a joint session of the House and Senate. Highlights include his review of his 16 years of service chairing the Supreme Court of Georgia’s Commission on Children. Representative Wendall Willard and I are the House appointees to this Commission which has led the state in child welfare reforms — thank you Justice Hines, who will be replaced as Chair of the Commission by Justice David Nahmias.
There are currently 139 Accountability Courts, funded as part of Governor Deal’s Criminal Justice Reform, and additional proposals are coming forth this year to reduce the number of Georgia citizens on criminal probation. Georgia has 6 times the number of citizens supervised by probation services than other states–inefficient use of tax money, that should focus on a smaller number of more dangerous offenders.

So...what would be some possible answers to solving this inefficient use of tax money? 

 And even better question asking,  which one of the two groups would I now fall into:  

1)  the ones having been denied probation  
2)  or the smaller number of more dangerous offenders needing to be focusing our attention on instead?

Although I still consider myself a Progressive,  I'm definitely having to borrow a moniker from our Conservatives just too perfectly fitting for all these culturally arrogant Emory affiliated elitist neighbors of mine...LIBTARDS!   As it relates to the inappropriateness of signage 1840 Mason Mill Road, you are all acting like a bunch of LIBTARDS!

This is James Avery the resident at 1840 Mason Mill Road which FOX5News posted a story Tuesday evening January 24th as I was being processed through DeKalb County Jail.

The following link will take you to an email uploaded to my blog that I sent to both of my public defenders Ingrid McGaughey and Whitney Gibbs as well as having forwarded (with additions) to select group of noteworthy members within our DeKalb County community.


Just thinking Fox5News might want to consider sending someone into DeKalb County Jail having to spend an entire day from sunrise to sundown experiencing the same treatments a small group of us had no choice but to endure as we were ordered from one location to another as we were being processed through the system expecting to be released at every turn/location as that was the only reason given to us as to why we were being moved in the first place. Then suddenly, without any reasons given, we are processed back to holding units deep within the confines of that jail wearing only what you were wearing when they handcuffed you and unexpectedly hauled you off to jail. I doubt you will ever understand just how cold and hard it can be trying to stay warm and/or sleep on those concrete floors when wearing only a thin dress shirt, surrounded by all that frustrated anger everyone is now venting. On top of all this, it was another couple more hours before staff called it a day and finally handed out blankets to everyone as they locked us up again two by two to units having cots with mattresses for us to finally lay on without even a reason for why we are still there or what we were to expect the next day. And it was only moments before all this, a mugshot of me shows up on the FOX5NEWS channel of the television set mounted high up on one wall. Seriously. Someone from Fox5News really needs putting themselves through the same conditions we endured for an entire day... first; then try imagining themselves being that person shown in that mugshot Seriously again! Someone could have gotten hurt. And for what? You blotted out so much, why then even draw attention to the signs in the first place? James Avery....profanities,,,,vulgar....was just about all that was left!  In others words, there were no facts presented backing up any of these claims regarding the resident of this property...James Avery.

However there is a silver lining to this piece of journalism I'm finding extremely amusing. Not only is the Headline to this piece about a judge ordering a man to kill profanity, explicit signs; the part of my LORAX sign you blotted out in this piece was the immaculate ejaculation hurled into my court hearing over different set of signs nailed to my trees at the time by the judge hearing that case back in February 2013.

This judge would not let me even bring into this hearing the green laws grossly violated by these two before moving into this house pretty much the same as the judge presiding over recent court hearing not allowing me bringing up for discussion the contents of these signs during the trial yet still having made contents of any signs post trial a possible violation of probation resulting in automatic jail time.

Are you not able seeing the irony in all this?

Also I wanting to point out, that somewhere on a sign within the confines of Atlanta Botanical Gardens, you will find one stating that an healthy acre of trees will sustain eighteen people. Although I'm not claiming the trees on my lot to healthy trees, it's still pretty much mostly just a bunch of trees slightly shy of an acre. Different way of saying the same thing, not only did my trees help provide the air my neighbors and your journalist needed to breath in before able talking to each other during their interview while standing on my neighbor's lot now almost completely devoid of all it trees, it still also my trees needing to help suck up all that aerobic waste of good air these two leave in their tracks wherever they go.

Also this most recent new piece mentions a Fox5News reporter having interviewed me back in December but does not name or show who this reporter is..? Although I do remember speaking with a woman holding up what looked like a iphone as we chatted briefly, definitely was not aware this was a reporter associated with Fox5News or any other news outlet I was speaking with..? And I definitely do remember discussing with this woman the meaning behind the monkeys hanging by their necks; probably word for word the same explanation given to these compeers of mine having shared same holding cell DeKalb County Jail the night you could have gotten me killed had they not woken me up first allowing me the opportunity of us watching it together. Otherwise I would have had no clue why anything that might have happened afterwards had even happened in the first place.

Would it be possible getting the name of this reporter who spoke with me; even a picture maybe? Even better, send both reporters back interviewing me for a more properly balanced piece of journalism this time around. I've definity a right knowing why this explanation of these sock monkeys hanging by their necks was not aired as well?

First I wanting verify that it was you Ingrid who entered by home and place plenty of food and water out for my cat Tater Tot and to thank you for doing so.  She is fine.  Bit embarrassed for you to have seen my home as messy as I left it that Friday morning.  

My mother and sister actually came to Atlanta from Prescott, Arkansas on Sunday once they found out online that I had been sent to jail; however I refused to see or speak with them when they tried to visit with me at the jail.  Although they tried staying long enough Tuesday to visit with me as they were mislead the same as I was that I was going to be released that morning, did not get out until mid-afternoon Wednesday; so did not get to visit with them before they left.  Have been refusing to speak with my mother since March 2014.  

Anyway, as we wait on this court hearing Tuesday January 31st, could you clarify just exactly what sign code ordinances I'm supposed to comply with?  Does this also include the three large crosses nailed to my trees along with the stuffed animals and nooses hanging from off the arms of these cross.  And it is my understanding that I am able being found in violation of probation by the contents of these signs; contents of these signs having been what I was wanting discussing during these hearing all along?  But the two of you absolutely refused even discussing the contents of these signs even just between the three of us!  Even to the point of accusing me of being the incompetent one for not being able understanding that this trial was only about square footage.  

So...would it be possible of the two of you coming to my home and me bringing all of these signs out for us going through one by one before this hearing before Judge McCoyd Tuesday?  I am still allowed four signs in addition to the crosses am I correct?   Let's not forget the SCOTUS Snyder vs. Phelps  8-1 ruling in favor of the Phelps rights picking with their GOD HATES FAGS signs.  As I'm understanding the Supreme Courts justices' ( minus Allito) reasoning's being that since the issue of God and Gays was already in the public domain being debated, to punish them in any way over these signs would be denying them their rights participating in this debate.  My being confrontational/offensive is just me exercising everyone else right to be offended/confrontational back at me!  Why are they unable dong so?  

JESUS WAS A CODE COMPLIANCE PROBLEM!  


OH!  By the way!  I returned to my home Wednesday afternoon finding all my signs had been pulled out of the ground and just tossed deeper into my yard from the sidewalk...minus one of them which appears to have been taken.   The one that said TRAGIC VISION OF HUMANKIND in the center, JR LEAGUE at the top with "ASK ME ABOUT THE DRESS" in between; MMCA at the bottom with "NOT GOING TO HEAR IT" in between.  The sign making fun of Mary Hinkel. 

Maybe you will find this as amusing as I did.  Tuesday night, after a long day of being shuffled from one place to another  as if nothing more than cattle, only to be disappointed learning that we were not going to be release that Tuesday after all (me attempting desperately trying to stretch out the battery life of both hearing aids long enough getting me out of there before going dead mostly by sleeping in corners of on the cold floor and avoiding conversation with others so I can keep them turned off), a group of my compeers who had been watching the News were suddenly shaking me awake and I turned my hearing aid on finding them all loud and trying to talk to me at the same time.  They had just recognized me from a mugshot Fox5News brief had just shown of me. Then I watched with them, while at the same time no clue how much they were able hearing as I was able hearing nothing,  Fox5News showing just enough for me to appear an outright racist!  And when it was over, sure enough,  they all turned toward me with one of them asking me outright if I was a racist.  Once I'd explained the meaning behind my use of those sock monkeys, JUST ONCE!,  they quickly calmed down and one even asked me to autograph his Styrofoam cup.  Which I was unable to do unfortunately.  Then I went back over this isolated cold spot on the floor away from everyone and just force myself into going back to sleep.  Something I'd learned as a relief vet, since most clients prefer to wait until their regular  veterinarian returns.  Something I call "WARPING" as it made time, even days, go by faster.  

But for argument stake, CRYING OUT LOUD! IT WAS A MUGSHOT!  WHERE THE FUCK! FOX5NEWS THINK I WAS?  SOMEONE COULD HAVE GOTTEN HURT!  VERY GOOD THING THAT PERSON WAS ME!  JUST ONCE! JUST ONCE THEY NEEDED HEARING ME EXPLAINING THOSE SOCK MONKEYS HANGING BY THEIR NECKS TO THEM!  THEN I WAS ABLE SAFELY GOING BACK TO SLEEP AMONG THEM WITHOUT BEING HARASSED, BULLIED, TAUNTED, THREATENED, HARMED, NO NOTHING!  YET SIX YEARS OF ATTEMPTS AT EXPLAINING THOSE SOCK MONKEYS TO THESE EMORY AFFILIATED CULTURALLY ARROGANT PROGRESSIVE ELITISTS NEIGHBORS OF MINE HAS YET TO UNLIST ME AS A HATE SPEWING RACIST!

I definitely think it would be a smart move on the part of the  BLACK LIVES MATTER movement taking up the cause attempting getting Dylan Roof's death penalty reduced to Life in Prison.  I did attempt explaining during my court hearing this past Friday, that it was through the manipulation of peckerwoods the like of Dylan into doing their dirty work is how the Conservative Elites maintain their control of power.  A good example of this would be the movie Chocolate starring Johnny Depp.  If the Black Lives Matter Movement able accomplishing this, then we might finally be able the beginnings of discussions leading to the elimination of the death penalty altogether.  

Also I'm curious about the $10,000.00 I recently donated to Georgia Innocence Project in memory of my deceased Father Charles Denson Avery, M.D. (He would never have approved);  have their been any talk/buzz going around as to what my motive might be for doing this?

Good Morning Sister,

I'm afraid I don't understand this email you've just sent.  Thought we had talked about this already during our phone conversation this past Thursday.

Originally the fine was set at $10,000.00 in addition to a 60 months probation period minus the first seven days I was supposed to have locked up in DeKalb County Jail per Judge McCoyd orders.  Apparently there have been some changes made to this sentencing, including, but not limited to jail time having to serve reduce to five days from seven.  It's also possible that the probation period may have been reduced from sixty months to six months as well. 
Currently it is my understanding that this court hearing scheduled for tomorrow Tuesday, January 31st, 2017 at 2:00 pm is Judge McCoyd only wanting to clarify the terms of probation.  

After witnessing, first hand, the ordeal one must go through getting processed  into DeKalb County Jail then the same ordeal repeated all over again getting out; I'm easily able seeing a "60" eventually getting carried over to another form as a "6" instead.  Although likely not a mistake, sixty months in jail over side code ordinance violation making absolutely no sense,  will not be all that caught off guard upon learning 60 months probation remains unchanged.  That's the point I was trying to make, even to my own family, with the ten thousand dollars having recently donated to Georgia Innocence Project of which the Honorable Judge Matthew McCoyd hearing my case is just one of GIP's many founding members.

BTW - just discovered last night, although having a receipt for this online donation of mine to GIP,  this activity hasn't shown up on my checking account yet....?  

Don't worry Donna, I will update you tomorrow afternoon after the hearing; or at least give Public Defender permission informing you on my behalf. 

But right now, I'm will be showing up at Georgia Innocence Project headquarters, located not far from my home actually, inquiring about this donation.

Hello Sister,

I have spoken with Whitney by phone this afternoon and she has been given permission discussing my case with you.  

May I ask why you are wanting to speak with her?  What it is you are hoping to achieve by speaking with her?

Although she nice enough a person,  she totally sucked as a lawyer.  

During this phone conversation this afternoon with Whitney, I also asked her about the sixty months probation vs six months question?  Although she not certain about this, she believes the six months probation was based on just one citation out the ten citation found guilty by the court; even though same code violation all ten of them.  In other words, if I keep violating sign code ordinances again, it's possible for me having to spend up to five years in jail.

I'm now also curious as to where Dana found all her information about the results of my court hearing when you had her searching the internet for you and mother?  Could you ask Dana to send me the links to all the sites found during this search?  

As far as the $10,000.00 donation having made to Georgia Innocence Project January 16th,  it failed to get process properly because of problems on GIP end.  So will be attempting another donation using a different web address given to me by a staff ;having spoken by phone.

Will call you tomorrow after my case status hearing with the Judge tomorrow afternoon,

Dana only found out you were in jail by going to dekalb county jail in Decatur Georgia! After you wouldn't see us Monday morning we went to your house to check on your cat and while I was doing dishes and loving on tater tot Richard went next door to Charlie bliss and ask him point blank what happened in court! Richard came back and told us what he said!

I called Ingrid this morning after I texted the e-mail to you and everyone else on detail! I left a message for Ingrid to call but never heard from her! I think she called me late this afternoon but I missed her call! Whitney responded to my e-mail real quick and then I sent her my phone number and she called!
