For years, Jim Ed Avery has decorated his yard on Mason Mill Road with vulgar signs and ranted and raved at cars passing by.

For years, his neighbors have been begging the county to intervene.

They made some headway when they were able convince officials to charge him under DeKalb County laws that specify the number of signs a person can have in their yard, CBS Atlanta reported January of 2017.

After a trial over the violations last year, Avery was ordered to pay $10,000 in fines and received five years probation. He spent a week in jail, CBS Atlanta reported.

But Avery did not stop, according to a YouTube channel that contains videos of his antics.

During a hearing on Feb. 12, Avery was found to have violated the terms of his probation and sentenced to 30 days in jail, according to the Mason Mill Civic Association.

"The violations occurred specifically on September 9, 2017 and November1, 2017, when Code Enforcement officers found that the signage he had in his front yard exceeded the square footage aUowed by the code," the Civic Association reported. 'When released from jail, Mr. Avery will be subject to drug testing every two weeks and visits from his parole officer. Also, code enforcement officers will be expected to view his property on a regular basis. Should he be found to be in violation of his probation again, a warrant for his arrest can be applied for immediately."

He will also be responsible for hiring his own lawyer after the Public Defenders Office was released from representing him.

The consequences could be even worse if Avery continues to violate the conditions of his probation.

"Judge McCoyd stated that in his original order he had tried to establish clear parameters and consequences that were fair to both Mr. Avery and the County," the Civic Association's email says. "However, it was clear that Mr. Avery had not taken the court proceedings seriously and that his display of excess signage signified his lack of concern about county ordinances and his defiance in complying with those ordinances.

''The Judge was not willing at this time to consider Mr. Avery in violation of his parole due to his creating a 'hazardous and offensive condition in our community.'  However, the Judge did seem to indicate that he might consider this argument in the future should Mr. Avery return to court."

The Feb. 12 hearing began at 9 a.m. and ended at 3 p.m.

"Several residents stayed until the bitter end," the Civic Association reported. "We were frustrated with the judgment, but were told by the lawyers present that a 30-day jail sentence is a very hefty sentence for what began as essentially a code violation matter, and that the penalties will increase should Mr. Avery continue to violate his parole conditions."

        This person is mentally ill, no? Are there no relatives or guardians to get him serious medical and psychological help? I don't blame neighbors for being uncomfortable living with this. But not sure that sentences and fines are going to make the neurons fire better.

            I live nearby and looked into the situation some time ago. As far as I can tell from his blog and other online posts about the subject, he suffers from bipolar disorder and it is going untreated.
            From what I know about our mental health system, as he's an adult and deemed able to take care of himself at an acceptable level, no one can really intervene and 'make' him get help so long as he isn't posing an immediate threat to himself or those around him. Unfortunately, he has a history of behaving in ways that are perceived as threatening or aggressive (i.e. crashing church gatherings and refusing to leave, cornering people and shouting at/debating them in a way that makes them uncomfortable and refusing to leave them alone, etc.) but since it hasn't escalated beyond that, it doesn't "count".
            Part of the reason the county has been reluctant to step in is because legal action is basically the only path open to them unless he consents to get treatment--which he won't. Obviously, throwing him in jail ain't the damn way, but our mental health system is fundamentally broken which is why so many people struggling wind up in jail. It's a sad situation with no real, meaningful path to a resolution that will benefit the community and get him some help.

              Does anyone know what the exact charges were? I'm confused about how a county code violation in magistrate court could result in a 5-year felony sentence.

              Here's the odd thing about this petition: first it was reaching a goal of 100 signature, then raised to 200 after reaching 100 signature, now having a new goal of 500 signatures. They certainly do seem to be a fickle bunch.

              Well I've solved that problem...kinda. But the petition really isn't about me; it's about our Code Enforcers not enforcing DeKalb County's Code. And...I really have no intention of arguing my case in court again.

              I do know that you have a right to choose your patients; but it would really be best, in the interest of all, you work with me on this instead of against me.               It's been a good while since the brief phone conversation between the two of us my failed attempt seeking CCCG's help facilitating some sort of reconciliation meetings between me, the neighbors once living in the house directly across the street from mine whom the patriarch George Robert Gary, Sr. MDiv, ThD also happened to be one of CCCG's counselors  at the time, as well as with the "United" Methodist Church in general. 

              Well a lot has happened since this phone conversation cut short by you without any explanation given to me as to why you thought it "absurd" this attempt of mine at reconciliation with the Methodist Church in general?  As this extremely brief phone conversation between the two of us cut short by you could technically be considered our very first consultation session together, I believe it fair of me judging your behavior/conduct ...unprofessional.  

              Well I'm just going forward to you an email having just receive from my probation supervisor Officer Davis that I'm hoping ... alone ... will be self explanatory as to what I'm seeking with CCCG?

              Clinical Evaluation and Court Ordered Services

              We offer DUI Clinical Evaluations, Alcohol/Drug Evaluations and Interventions. These assessments may be mandated through the court, state, and/or probation officer, suggested by a lawyer, or requested by family members. The evaluations are used as a tool to determine one’s need for treatment. After the evaluation, recommendations are given as to the level of care needed.


              Do you, or do you not, offer court mandated clinical evaluation for substance abuse?

              Please do keep in mind that I've already been on that side of Georgia's health care three times.  And if I'm having to pay for it, I'd rather seek this court ordered substance abuse evaluation the place of my choosing.  And I'm able seeing no reason why we can't at least start with Care and  Counseling Center of Georgia?  All I'm needing before my next code compliance hearing October 17, 2017 is a hard copy clinical evaluation report able putting in Judge Matthew McCoyd's hand.  Maybe you are already able writing one up for our Judge McCoyd just being my neighbor up the street from me?  God  knows you certainly have no excuse not knowing way more about the circumstances involving defendant 1840 Mason Mill Road than Winn Way Mental Health Center. 

              Would this be asking too much our Care and Counseling Center of Georgia's clinical director?

              P.S.  It definitely would be far more therapeutic for me being able sharing my deepest thoughts with someone of my choosing than someone else choosing.  Surely this isn't an unreasonable request?

              And one more thing,  about a week ago, George Robert Gary, Sr. MDiv, ThD loops around the driveway of his daughter's property directly across the street from my home, and without stopping says to me, "You are doing exactly what you want to do."   Until Bob Gary or any one of you "Master?of?Divinities" stop putting up barriers and start talking to me,  I'm having no idea what it is you guys are thinking I'm wanting to do?  That's something I'm thinking Care and Counseling Center of Georgia far better equipped providing the help I'm needing more than anything Winn Way Mental Health Center having to offer?
