Can you please contact Mr. Avery and see if he wants to appeal and if so, will he hire his own attorney or does he want the court to appoint us to represent him on appeal. This was quite a case and it appears to me there are some excellent issues to appeal. I also heard that you did a wonderful job representing a very challenging client.

If you need an attorney to represent you in your DeKalb County case and would like to see if you qualify for appointed counsel, please submit your completed application to our office either in person or by mail. The application is available by clicking here. It is a Microsoft Word fillable form and requires MSWord to open and function properly. Applications are also available at our office.
If your case is in the Traffic Division of the State Court of DeKalb County, you may fax your application to 404.294.2014. Once your application is received, it will be reviewed and you will be contacted by a member of our office. Applications for Traffic Division cases are typically reviewed within two business days.
Please note that Georgia law requires each applicant to pay an application fee by money order of $50 (O.C.G.A . Section 15-21 A 6(b)). Under certain circumstances, the court in which you will appear may waive the fee.

Hello Mrs. Saari,
I just recently received from my public defender Whitney Gibbs, copies of everything I could possible get from her regarding her handling of my case; per her words, everything but her "attorney generated" products...? What ever the fuck that means!
Having just now reviewed this folder, guess I got my answer as there is absolutely nothing in it that give you any indication as to what kind of defense Whitney had in mind as my counsel.
Unless ...THAT... pretty much...ALL.. there was to it it!
However there was one piece of information in this folder that was news to me...
An email from you dated Jan.26, 2017, asking Whitney to "contact Mr. Avery (actually it's Dr. Avery but you can address me as Jim Ed or simply Jim if Dr. Avery is too difficult for you) and see if he wants to appeal and if so, will he hire his own attorney or does he want the court to appoint us (Circuit Public Defender) to represent him on appeal."
We had discussed this just before my status update hearing before our honorable Judge Matthew McCoyd on Jan. 31, 2017 and at the end of the hearing when Judge McCoyd asked again.
I'm curious...
What was Whitney's answer to you?
Certainly wasn't in this folder. Nor any of all the emails up until "THE TRIAL" having sent to my public defender Whitney Gibbs trying to discuss a defense!

As I wait on this answer, I'm going ahead and asking other questions I'm having about this past "THE TRIAL."

A joke to share:
Three women die in a car accident and go to Heaven. Saint Peter meets them at the Gates and welcomes them saying “you can do as you please in Heaven, just don’t step on any ducks.”
The women are puzzled but proceed into Heaven. Looking around, they notice there are ducks everywhere. In a matter of minutes, one of the women steps on a duck.
Saint Peter walks up to the woman with a hideously ugly man. Saint Peter shackles the man and the woman together and says, “for stepping on a duck, you have to spend eternity chained to this ugly man.”
The other two women are shocked but go about their business until, sure enough, another woman steps on a duck. Immediately Saint Peter comes and shackles her to another ugly man.
The last woman tries desperately to not step on a duck. After a few months of not stepping on any ducks, Saint Peter walks up to the woman accompanied by a stunningly handsome man. He shackles the woman to the man and after a while, the woman being thrilled to be chained to such a handsome man, says “I don’t know what I did to deserve this.”
The man replies, “I don’t know what you did lady, but I… stepped on a duck.”
To explain the duck, wearing a rainbow colored chain necklace, swinging from off one are of the cross.
