To Whom It May Concern,

This is James Avery, resident 1840 Mason Mill Road.

I came in roughly seven days ago and filled out an Open Request Form seeking ...ALL... informations possible (Emails, Memorandums, Service Request/Complaints, Court Hearings, etc., etc., etc.) on file with DeKalb County Code Enforcement Division relating to inappropriate signage 1840 Mason MIll Road.  Understanding this would take a good bit of time putting together, I then left with the understanding that someone would be calling me back with an estimated cost.

I have yet to hear from anyone?

And it is my understanding that this information should have been provided to me within 3 business days?

Please advise.

It's appearing already that the same trouble I'm having with getting copies of my file with Emory Police, DeKalb Crisis Mobile Unit, Georgia Regional Hospital, Law Office of  Public Defender, as well as meetings with various elected officials, and even pastors of various churches, the same trouble I'm going to be having with DeKalb County Code Enforcement?

Sincerely yours,

James E. Avery, D.V.M.

P.S.

I've made a new sign.

No point in me even asking to hear your thoughts about these signs.  You simply are not willing discussing these signs with me.

Leaving me no other options but to conclude...I'VE HIT IT ON THE NAIL!!!

Hello Tonza,

Thank you for replying back to me.

I have read your response to my Open Records Request.

And I do understand that I'm expected to pay for copies of these document  as well as administrative cost for assisting me with this request.

Correct me if I'm wrong, but your response reads as if you are expecting a prepayment now?

Before anything else is done?

If correct, just need to know the amount?

Or do you need more time gathering the documents before you have a cost estimate?

If so,  roughly when can I expect to hear from you with this cost estimate?

Sincerely yours,

James E. Avery, D.V.M

Hello Tonza,

Pleasure meeting you this afternoon when I dropped in at DeKalb County Code Enforcement Headquarters picking up copy of my file.

However I was very disappointed seeing there were only thirteen sheets of paper in manila envelope handed to me this afternoon; seven of them being copies of email exchange  between me and you regarding my request for copies of my file with DeKalb Count Code Enforcement from October 22, 2012 through present date.

Re:
Case notes of court case of DeKalb County vs. James Edward Avery.

The official write up will come from Solicitor Getz..

Sentencing:

1. 1,000 dollars fine per citation (10 citations) totaling 10,000 dollars.
2. Avery to time on probation (60 months)
3. Avery will serve 1 week in jail beginning immediately
4. Once released, Mr. Avery has 30 days to clean property and property to be free of code violations
S. If Mr. Avery doesn't comply and is found to violate the Judges sentencing; Mr. Avery will spend 2 weeks in Jail
6. Once released, Mr. Avery has 30 days to clean property. f-
7. If Mr. Avery doesn't comply, Avery will spend 30 days in Jail.
8. Upon release he has 30 days to clean property.
9. If Mr. Avery doesn't comply, Avery will spend 60 days in Jail.
10. Upon release he has 30 days to clean property.
11. If Mr. Avery doesn't comply, Avery will spend the balance of time in Jail.
12. Every 6 months defendant is in compliance, 1,000 dollars will be suspended.

As I understand from Solicitor Getz,

The probation department will monitor the order/sentencing of Judge McCoyd; this will relieve code enforcement from
this task. However, if a new compliant is lodged against Avery, then the code enforcement will have to inspect. Getz
informed the gallery of on lookers/neighbors of this monitoring process.

FYI Tonza,

While Officer Dewitt and I were re-inspecting 1840 Mason Mill Rd (Avery, James owner) for court scheduled on January
20th 2017 at 1 pm, there were MEDIA ATTENTION AND RECORDING of our activity. I wasn't able to identify the t.V.
station involved however, we did not speak to them/him at all.

Mr. Avery went into the house to retrieve all his signs and threw the signs in the yard. Only photos and measurements
taken at this time.

Except for pictures Officer Housworth and Officer Dewitt took the day of January 19, 2017, the above information is all that I've received.

Are you sure this is correct?

Sincerely yours,

Hello Tonza,

Recently sent you an email questioning the records released to me May 18th, 2017.

When considering how quickly you've responded to earlier emails of mine requesting copies of all records possible regarding inappropriate signage 1840 Mason Mill Road on file with DeKalb County Code Enforcement dating back to October 22, 2012, thought it best I follow up with this email making sure you have received this email?   Inquire as to whether or not I'm to be expecting a response from DeKalb County Code Enforcement?

Sincerely yours,

James E. Avery, D.V.M.

P.S.

I've also sent emails to Supervisor Silvers,  Officer Lorena, and Officer Housworth during this time frame requesting  copies of these records.  It would be nice seeing copies of these emails and their response (lack of response) among these records as well; the same as emails from John Bugge and Patrick Noonan concurring along with George R. Gary, Sr. ThD and his wife Janet Claire Segers Gary had been save to my file earlier copies requested from DeKalb County Code Enforcement..?

Re:  Your Open Record Request:  James Avery, Citation number:  026695, 027588, 026200 & 027591

Dear Mr. Avery,

Your request was received on May 9, 2017

With respect to the request being made pursuant to the Georgia Open Records Act, please note that the Georgia Attorney General's Office has opined that "courts and other agencies of the judicial branch have a history of self-regulation." Op. Att'y-Gen 79-25. That opinion cited the court's decision in Sams v Olah, 225 Ga. 497, cert den., 397 U.S 914 (1969) for the proposition that "the regulation of the judicial branch of government belongs inherently to the judicial branch itself." In Fathers Are Parents Too v. Hunstein, 202 Ga App. 716, 717(1992), the court discussed the Open Meetings Act (0. C.G.A § 50-14-1 et seq.) and stated that "because current Act ... does 110t specifically reference the judicial branch, nor otherwise apply to the judiciary in clear and unmistakable terms, we conclude that the Legislature did not intend for the Act to apply to the judicial branch of government." Similarly, the Open Records Act does not name or specifically reference the judicial branch. See O. C. G.A.§ 50-18-70 et seq.

Subject to the foregoing, pursuant to the Uniform Superior Court Rule 21, the Court's records are available for inspection and copying during normal business hours at a reasonable cost. The court has the following documents on file:

  1. Transcript (98 pages)
  2. Audio recording (January 3, 2017 session)

In regards to an audio recording, these cases did were not schedule for hearings on: 02/19/2013, 11/27/2013 and 01/20/2017. Unfortunately, an audio recording was not available for the following sessions: 07/12/2016,08/09/2016,0]/31/2017,02/28/2017 & 04/18/2017.

Please note that in accordance with legislation applicable to the Court, the total estimated cost to search, retrieve and copy the requested documents is $58.99. The fee for copies is 98 copies at $.50 per page, or $49.00. The fee for an audio recording is $9.99. Please submit a certified check or money order for $58.99 to the "State Court -Traffic Division" as payment. Upon receipt of payment, the requested documents will be provided to you or your designee.

Sincerely,

Silence Equals Consent : Dialogue Equals ?

https://en.wikipedia.org/wiki/The_quick_and_the_dead_(idiom):  The Quick and the Dead is an English phrase originating in William Tyndale's English translation of the New Testament (1526), "I testifie therfore before god and before the lorde Iesu Christ which shall iudge quicke and deed at his aperynge in his kyngdom" [2 Tim 4:1], and used by Thomas Cranmer his translation of the Nicene Creed and Apostles' Creed for the first Book of Common Prayer (1540). In the following century the idiom was referenced both by Shakespeare's Hamlet (1603) and the King James Bible (1611).
The use of the word quick in this context is an archaic one. Here, the word specifically means living or alive (a meaning still retained in the "quick" of the fingernails, and in the idiom quickening, as the moment in pregnancy when fetal movements are first felt. Another common phrase, "cut to the quick", literally means cut through the dead, unfeeling layers of the skin to the living, sensitive tissues below.
The phrase is found in three passages in the 1611 King James version of the Bible: in the Acts of the Apostles (Acts 10:42), Paul's letters to Timothy (2 Timothy 4:1), and the First Epistle of Peter. The last reads: "For the time past of our life may suffice us to have wrought the will of the Gentiles, when we walked in lasciviousness, lusts, excess of wine, revellings, banquetings, and abominable idolatries: Wherein they think it strange that ye run not with them to the same excess of riot, speaking evil of you: Who shall give account to him that is ready to judge the quick and the dead".
This passage advises the reader of the perils of following outsiders in not obeying God's will. Specifically it warns that those who sin, both the quick and the dead, will be judged by Jesus Christ. In other words, it implies that God is able to act on the sins of a person whether that person is alive (quick) or has passed into the afterlife (dead).

James Avery Hello Elena. Thank you for allowing me the opportunity after the town hall meeting was over sharing some concerns of mine regarding upcoming compliance hearing relating to inappropriate signage 1840 Mason Mill Road. Just wanting to repeat some of my thoughts having shared with you that evening as we were walking down that long hallway. First I quoted Martin Luther King's "Injustice anywhere is a threat to justice everywhere." Then I asked what that quote means to you? Although you attempted answering my question, it was apparent to me this was a question having caught you off guard; one needing more time/thought put into it. So I went ahead and shared what is now my current understanding of this quote by MLK resulting from my experience over these signs of mine having everyone upset. "If there is a line that can be reached where you resort to manipulation, deception, perniciousness, prevarication, looking the other way, refusing to acknowledge, feigning ignorance; then in the end after all is said and done, I don't care how far apart these lines are, you (The Progressives!) are no different or better than them (The Conservative!)." Next, I spoke of the neighborhood I'm wanting to believe I live being one that extends halfway around the world in all four directions to a same point in the "Indian" Ocean; that you can't get any bigger a neighborhood than this. That a person who actively makes an effort thinking like this is going to think/behave differently than one believing just Mason MIll, Decatur, Georgia, the South, USA, etc., to be his/hers/their neighborhood. James Avery Again, before this upcoming trial/code compliance hearing April 18 that very well may end up with me in jail for three weeks, it would be nice of you reaching out to me and allowing me a chance explaining my actions. Otherwise, if unable finding anyone supportive of anything I'm trying to stand up for, then, I'm ready to give up. Having the Sherry Boston/Charles Butts sign in mind which was censored by Fox5News, If Dylan Roof still prefers life in prison as opposed to death by lethal injection, I would like to discuss the possibility of State of Georgia doing a prisoner swap with State of South Carolina. In exchange, I will forgo all appeals in South Carolina contesting Dylan's death sentence, in the process, saving South Carolina time and money; State of Georgia getting to decide Dylan Roof fate after Dylan first earning a Master of Divinity certificate from Emory the same as they did with Kelly Gissendaner; "There is no greater an agony than a story needing to be told." ~Maya Angelou
Mary Alice Bray I couldn't find a place to park. Could you have the next meeting at the elementary school? There seems to be a lot more parking there.
Jennifer Harris Hart Dangit! I was actually there until 640 last night. I saw ppl coming in buy had no idea. I totally would e stayed. ðŸ˜ž
Elena Parent Brisendine So sorry you didn't find parking Mary Alice! There was a lot going on at the school last night.

Hello Officer Davis,

I'm  assuming this email was sent before your trip out to my house yesterday afternoon.

To answer your question; all is the same.

But thank you anyway for checking up on me for my sister calling from Arkansas.  She's wanting me flying home for a visit; but that is not going to happen!  And the interesting thing about all this...that's where all the guns are as well!!!  I have never owned a gun (except for the shotgun given to me by my brother while I was still in elementary school) or even cared to own a gun, but it kinda pisses me off knowing my name might be on that list of people forbidden to buy a gun!  It's tempting, the idea of me going home just to have a few pictures taken of me with my brother's Bushmaster to upload to my blogs here in Atlanta!  THEN  SIT BACK AND WATCH THEM LIBTARDS ALL HAVE A COW!!!

If I'm going to have a probation supervisor assigned to me, I'm taking advantage of it then,,,BEST FRIEND!

Sincerely yours,

James E. Avery
