Infamous shouting man receives $10K fine, jail time for yard signs

Neighborhood desperate to end man's daily shouting routine

(Source: WGCL)(Source: WGCL)
DECATUR, GA (CBS46) -
His name is James Avery and he's got a lot to say.
The only problem is, no one wants to hear it.
"Our property values have plummeted because of this guy. Nobody wants to live in a neighborhood where this is going on," said neighbor Charles Bliss.
As far back as 2011, neighbors say Avery has been posting signs in his yard every day and cursing at drivers from his house on Mason Mill Road. The messages on the signs range from confusing, to downright offensive.
Neighbors say most people try to avoid the area if they can.
"Because they know that once they walk up there, they're going to have to walk past that. The vulgar signs, the swearing at the cars, the yelling profanities," said neighbor Ron Mihelic.
There's also concern that when cars stop to read the signs on the sharp curve, it creates a dangerous situation.
For a while, neighbors thought they were stuck with a hopeless free speech issue, but then they got an idea. DeKalb County has laws restricting the number of signs a person can have in their yard to 24 square feet, which Avery clearly violates.
Avery spoke to the CBS46 crew with incomplete sentences, mostly shouting unintelligible gibberish. Our cameras were rolling as code enforcement officers stopped by the house to take measurements. They appeared to be also checking the distance each sign stood from the road.
At this point the man is getting cited on almost a daily basis, and yet, the shouting and dancing routines continue. CBS46 wanted to get answers for the neighbors on this street, so we asked the county commissioner of this district why there haven't been more results.
"Our code enforcement system is designed to deal with rational situations. This does not necessarily have all the features of a rational situation," said Commissioner Jeff Rader from DeKalb County District 2.
There were questions about Avery's mental health and it created delays, but he's recently been declared competent to stand trial.
"You can't just completely ignore the law. Eventually there will be criminal penalties associated with that and he could lose his freedom," said Rader.
Neighbors are less hopeful.
Mihelic thinks fines are not going to be good enough.
"To him, money is not really an object. I'm not sure what it costs for him to live, but he'll pay the fine and keep on doing what he's doing because to him, this is what's important."
Charles Bliss said he feels like a hostage, unable to sell his house to get away.
"We even had a contract to buy and the people backed out specifically because, as they said, who would deliberately move next to a crazy person?"
At a trial for his yard sign violations held Friday, January 20, neighbors tell CBS46 Avery was ordered by a judge to pay $10,000 in fines, with 5 years probation, the first week of which will be spent in jail.

Part 2)

I'm not expecting us finding much we agree upon; just thinking a chance the outcome might be somewhat surprising/amusing to the both of us.

[Wikipedia, The Free Encyclopedia - Shirley Lynn Phelps-Roper (born Shirley Lynn Phelps, October 31, 1957) is an American lawyer and political activist. She is best known as the former spokesperson of the Westboro Baptist Church of Topeka, Kansas, an organization known for its highly publicized homophobic public protests conducted under the slogan "God Hates Fags." Phelps has been highly criticized and taunted by the media for her perceived religious fanaticism and poor parenting.

Phelps-Roper practices law for Phelps-Chartered Co., the Phelps family's law firm established by her father in 1964, and is currently licensed to practice before all Kansas courts up through the United States Supreme Court.

Besides her father Fred, Shirley Phelps-Roper has been the most active spokesperson of the Westboro Baptist Church and answers many of the e-mails sent to the church in a column called "Dear Shirley."

Phelps-Roper and the church have received media coverage for the group's aggressive preaching and controversial campaigns such as the picketing the funerals of AIDS victims with signs such as "God hates fags" and funeral processions for American soldiers killed in combat.

In 2014 it was reported that Phelps-Roper's duties as spokesperson for the Westboro Church had been reduced, and her authority transferred to an all-male board of elders.]

Although I label myself a radical atheist as an adult, I'm okay with being labeled a Methodist Fag due to my first eighteen years raised with the help of First United Methodist Church of Prescott, Arkansas. As we must first be introduced to God before being aware of God, I have only recently realized that I have always been and forever always will be Methodist til the day I die; no less than Jesus ever stopped being a Jew.

Absolutely refuse being labeled a Christian as it tells you absolutely nothing about anyone.

[Wikipedia, The Free Encyclopedia - Though the main purpose of the Priests Rape Boys website is to criticize Catholicism, the WBC also criticizes several mainline Protestant churches on the website, including Methodists, Presbyterians, Lutherans, Anglicans, and Baptists. The WBC states that

...their preachers have shirked their responsibility to tell people the truth about sin, and instead lie to them about what the Lord their God doth require of them. If these lying, false prophets told people the truth about what God says regarding those who suffer sin upon their neighbor (Lev. 19:17–18), there wouldn't be any butts in the seats when the plate got passed. These preachers are not preachers of righteousness, they are teachers having itching ears (2Tim 4:3), and they absolutely count on the abysmal bible illiteracy of their parishioners ... "Priests rape boys" is indeed an air-tight, three word case against all of the mainline "christian" churches – their preachers and members, without exception. They are all going to Hell!]

Although I do not completely agree with the over generalization with the above statement by your church, you did hit it on the nose with our Methodist. They do have "itching ears."

Because of a feud between me and members of Glenn Memorial United Methodist Church located on Emory Campus, I have recently conceptualized my suicide based on my theological orientation. Was wondering, would you and your church be interested in preemptively picketing the funeral of TAO~g(SIMPLY JIM: METHODIST FAG THE POLITICAL CATALYST)d~OG at his home.

I do own my home outright.

And there is a sidewalk running down my side of the street as well.

And you are most welcome to picket my home from this sidewalk passing through my property while your van parked in my driveway.

Or you could turn you attention elsewhere?

As the faculty and students are leaving Emory University during later part of the afternoons; can be a good bit of traffic passing by in front of my home. Sometimes backing up on Mason Mill Road down the hill in front of my home due to stoplight at the Clairmont intersection just up the hill.

Sincerely yours,

James E. Avery, DVM

p.s. Could you at least let me know that you have received this email. I'm a bit suspicious my emails are being tampered with. Just too quite out there..? Feel free using what every language you like. Will not offend.

"You think our job is to win souls to Christ. All we do, by getting in their face and putting these signs in front of them and these plain words, is make what's already in their heart come out of their mouth."

Dear Shirley,

I am unable disagreeing with anything you have said within this quote I came across just recently being credited to you. And for some reason since, I'm wanting to meet you. I had already told myself before the Supreme Court issued their ruling with the Snyder vs. Phelps case, that I was going to be completely okay with a ruling in your favor; although a FAG myself. Just another word for homosexual. Having eleven children yourself, can just as easily label you a SOW. That's still a pig ain't it? Even a SWINE.

If right is right, wrong is wrong; then something not quite right, nor completely wrong, has to fall somewhere in between..? And something is telling me when looping into a circle what I thought was a line originally, there is a chance, although more likely not than so, you and me might have a lot more in common than we both are wanting to believe; at least the way we are seen from the perspective of others.

I am an avowed fifty-three year old self-avowed practicing homosexual currently living within the shadows of near-by Emory University. And during the course of my gay lifetime, which would be half my lifetime, I have had sex with over more than a thousand men.

Do not get me wrong. I am not bragging.

Just Simply Jim simply stating a fact as to how his life happened. But I do get a kick out of watching people predictably reacting to me telling them this. Even a crystal meths dealer of mine was appalled upon hearing me telling him this.

"I thought you had a boyfriend...?"
~(Simply Jim: Mature Methodist Crackhead)~

"I DO HAVE A BOYFRIEND!"
~(Drug Dealer)~

"Then you just count that one every day; wasn't bragging here."
~(Simply Jim: With Each Day I Love You More..?)~

Nor am I ashamed of my past.

You learn as you go. And I've learned a lot about the true nature of people, even about my very own family and tribe I thought I's at least knew, the hard way that could not have been learned any other way. The same as you have. Through Constructive Confrontations as I like calling it.
Rob Reynolds
So James, is your dispute with Emory because they are Methodist, and you blame the Methodist Church for turning you into a Psycho Meth Addict ?
I work at the Yerkes Primate Research Center, and we use the screaming chimpanzees to control your behaviour and make you do meth, and there's nothing you can do about it.

As opposed to my understanding of God equating with indifference (infinite); just another "Classic Eight" here. But here is where I stand apart from Emil Cioran; indifference here is pathology somewhere else.

Everything I'm doing out by the street on sidewalk my stretch of property is nothing more than gimmicks making it impossible of me being ignore/dismissed so easily by others; most especially by the culturally arrogant progressive elitists of Emory. After those two weeks of inconsolable rage having been so easily involuntarily committed to Georgia Regional Hospital by my 80 years old rural Arkansan Methodist mother with the help of my big sister, in addition to the perniciousness and prevarications retired minister Bob Gary along with his wife Janet and their children Bert, Susan, Bill, Ted stood by and allow to grow, even help fan, there is no such thing as stage fright anymore.

"Better to be looked over than overlooked." ~Mae West

Trust me. I am perfectly aware just how bizarre all this looks. All I'm wanting is for Emory University sitting down with me and helping me tell our story...A METHODIST TRIBUNAL. For Emory to gut it up and just help me get all the facts out there without any manipulation and/or deceptions. And let the chips fall where they may.

TRUTH BE GOD; UNIVERSAL ONE INSTEAD?

As we must first be introduced to God before being aware of God. As I was born into First United Methodist Church of Prescott Arkansas population 4000. Helped raised by that church right up until graduating Prescott High School. As stuff put into our heads when children never really goes away. I'm only realizing recently as an adult, although I label myself radical Atheist, that I have always been and forever always will be Methodist until the day I die no less than Jesus ever stopped being a Jew. That one can be both Atheist and Methodist (in this case "Methodist Fag" as it's still in their book of discipline that self-avowed practicing homosexuals cannot become ordained Methodist ministers), while at the same time, refusing labeling oneself a Christian as the word Christian tells you absolutely nothing about anyone. Now if others want to label me a Christian for whatever reasons of their own, they are more than welcome to do so. But let's be honest with ourselves; this isn't how it works...is it?

As the United Methodist Church had the first eighteen years of my life, the most impressionable years of my life, I expect of them at least, excepting some responsibility of failing me as a child if they are going to fault me in any way as Atheist Fag Chrystal Meths Addict man I am today.

It's getting late, and I'm getting tired. So I'm just going to sign off with my understanding of John 5:30

We can of our own selves do nothing: as we sense, we judge: and our judgement is just; not because we seek the will of our own the the will of the collective unconsciousness which cometh before us.

To me, this is nothing more than determinism; every extension of knowledge the results of first making the conscious the unconscious.

Leaving intentions left over creating the realities.

If there is one thing I am certain about, it's not me who's not doing the right things as it relates to inappropriate signage 1840 Mason Mill Road.

Just call me a spherical bastard.

Philip Jaffe Humor me Philip. Momentarily forget everything you're ever seen, heard, or read about me; then, with an open mind, try reading again this comment of mine responding to a news article about me having been uploaded to the internet.

Principle of Charity (Wikipedia- The free encyclopedia)

In philosophy and rhetoric, the principle of charity requires interpreting a speaker's statements to be rational and, in the case of any argument, considering its best, strongest possible interpretation. In its narrowest sense, the goal of this methodological principle is to avoid attributing irrationality, logical fallacies or falsehoods to the others' statements, when a coherent, rational interpretation of the statements is available. According to Simon Blackburn "it constrains the interpreter to maximize the truth or rationality in the subject's sayings."

Willard Van Orman Quine and Donald Davidson provide other formulations of the principle of charity. Davidson sometimes referred to it as the principle of rational accommodation. He summarized it: We make maximum sense of the words and thoughts of others when we interpret in a way that optimizes agreement. The principle may be invoked to make sense of a speaker's utterances when one is unsure of their meaning. In particular, Quine's use of the principle gives it this latter, wide domain.

Since the time of Quine et al., other philosophers have formulated at least four versions of the principle of charity. These alternatives may conflict with one another, so which principle to use may depend on the goal of the conversation. The four principles are:

The other uses words in the ordinary way;
The other makes true statements;
The other makes valid arguments;
The other says something interesting.

A related principle is the principle of humanity, which states that we must assume that another speaker's beliefs and desires are connected to each other and to reality in some way, and attribute to him or her "the propositional attitudes one supposes one would have oneself in those circumstances" (Daniel Dennett, "Mid-Term Examination," in The Intentional Stance, p. 343).

Then help me answer your question by first letting me know of everything, if anything at all, within my posting that did make any sense to you?

Do not get me wrong. I'm am perfectly aware that your question most likely rhetorical.

Beverly Nickens OMG...This is the guy we pass by all the time leaving from work. I stopped one day (while he was not outside) to read some of those many, many signs he has placed in front of his home and they are horrible and vulgar. Then several times I noticed he puts his middle finger up at every car passing his home. I can't imagine having to live next to him, with all that screaming. Irvin Fitzgerald
