U.S. Circuit Judge Brett M. Kavanaugh: Trump's Nominee for SCOTUS

***
U.S. Circuit Judge Brett M. Kavanaugh
looks on as President Donald Trump introduces him as his nominee to the Supreme Court on July 9.

https://www.nbcnews.com/think/opinion/brett-kavanaugh-s-supreme-court-nomination-result-years-unopposed-conservative-ncna890226:  The most important player is the conservative legal movement is the Federalist Society, created in 1982 to counter the perceived liberal bias of law schools. It has become a well-funded and hugely influential organization, transforming itself into the go-to group that conservative would-be judges need by their side. Important scholarly books by political scientists Amanda Hollis-Brusky and Steven Teles have shown how the organization influenced a generation of conservative judges and legal scholars, and provides the information Republican presidents now rely on to pick federal judges.

McCoyd 93L appointed as DeKalb County magistrate
By Emory University School of Law | Emory Law | April 15, 2015

Matt McCoyd 93L, long-time Emory Trial Techniques instructor, has been appointed to serve as a judge with the DeKalb County Magistrate Court. “I am honored to have the opportunity to serve the citizens of DeKalb County in this position,” McCoyd said, noting that he plans to continue teaching at Emory University School of Law.

McCoyd has already had an impressive career, serving for seven years as a senior assistant district attorney in DeKalb County, primarily in the White Collar Crime Unit, where he prosecuted RICO, white collar, and other complex criminal cases. He received the "Master Advocate" designation from the National Institute for Trial Advocacy in 2005.
He currently teaches Evidence, Advanced Evidence, Cross-Examination, Advanced Criminal Trial Skills, Pretrial Litigation, Litigating Identity in the Age of Scientific Advancement, and Jury Selection/Jury Dynamics. He also serves as faculty advisor and a competition coach for the Emory Law Mock Trial Team. He is a past president of the DeKalb Bar Association, a founding member of the Georgia Innocence Project and a member of the American Constitution Society.
The Chief Magistrate nominated McCoyd to the Superior Court Judges, who voted in committee on whether to approve and appoint him. As the confirmed nominee, McCoyd’s name was then sent to the governor for affirmation of the appointment. McCoyd was appointed midterm and will be sworn in on Friday, May 8, 2015. He will serve the remainder of the term through December 2016 and will be up for reappointment for a four-year term beginning on January 2017

Hello Ingrid,

While my mother and sister were here in Atlanta recently visiting with me, my sister shared with me something she's claiming you said to her during a conversation between the two of you regarding my case.

Is it true you told Judge McCoyd that he would actually like me if he knew me outside of this case?

If true, I'm unable seeing any reason, other than blind/biased loyalty to Emory University, why Judge McCoyd could not take an interest in discussing the contents of these signs with me.  A simple act like this would most certainly be a step in the right direction toward resolving this neighborhood conflict.

Without even the need changing anything about the terms and conditions of probation I've incurred resulting from this "THE TRIAL!

Sincerely yours,

Not Defined, Undefined, Unidentified~g(8!0)d~James E. Avery, D.V.M.

P.S.  I've confronted Rev. Dr. Alice this past Sunday after Glenn UMC evening "THE GATHERING" worship service about me wanting  Emory University and Glenn Memorial UMC officiating a non-criminal facts finding justice hearing.  About us all voluntarily putting the truths out there and letting the chips fall where they belong.

Boiling it down, I basically told her, "Same as the lesson that's needing to be learned from the reading of our New Testaments ought to be 'first to the Jews, then to the Gentiles,' the same it's needing to be with me...First to our Methodist, then..?

19 On the evening of that first day of the week, when the disciples were together, with the doors locked for fear of the Jewish leaders,Jesus came and stood among them and said, “Peace be with you!”20 After he said this, he showed them his hands and side. The disciples were overjoyed when they saw the Lord.
21 Again Jesus said, “Peace be with you! As the Father has sent me, I am sending you.” 22 And with that he breathed on them and said,“Receive the Holy Spirit. 23 If you forgive anyone’s sins, their sins are forgiven; if you do not forgive them, they are not forgiven.”
~(John 20: 19-23)~

She gave me pretty much the same kind of feedback her Associate Pastor Brent Huckabee gave me when asked if he would be willing continuing, at a later time, a discussion we were having about 'breath.'

It wouldn't surprise me they both place another incidence report with our Emory Police.

Oh!  And we probably should add to these incidence reports, the conversation I tried having with Rev. Pinson after Senator Parent and Representative Oliver's town hall meeting held at Glenn Memorial UMC that evening I was wanting discussing my trial and terms of probation..

Hello Ingrid,

My sister somehow had also gotten the impression during her conversations with the court ordered public defender assigned to me by our Judge McCoyd...that... you liked me as well?  Is this also not true?

Although she no longer likes my probation supervisor because he never returned any of her emails or phone calls with questions preceding my last code compliance hearing, she also said the same of Officer Davis?

"Donna.  Are you not aware just how much Joy Behar has done for your little baby brother than all your chocolate chip cookies put together?"
~(James E. Avery, D.V.M.)~

"OH I HATE HER!  HELL I DON'T KNOW?!  I DON"T EVEN VOTE!  WELL FINE THEN!  I JUST WON'T SEND YOU ANY MORE COOKIES!  THAT "D" IN MATH!  WHO CARES WHAT "Y" EQUALS!"
~(Donna Gail Avery Devine)~

Too bad really.  I was going to suggest she send him a batch of her chocolate chip cookies.

Sincerely yours,

P.S.  Why not try getting CBS 46 News Anchor Kim Passoth into another interview regarding Inappropriate signage/behavior 1840 Mason Mill Road, only this time around, having me, my neighbors, you as my Public Defender, Probation Supervisor Officer Davis, Code Enforcer Officer Houseworth all present together?  The more the merrier!

Code Enforcement showed up late afternoon Friday taking pictures.  But it wasn't Officer Houseworth as it was supposed to be.  The woman driving this vehicle wouldn't talk to me or give me her name either.

Hello Ingrid,

This is what my sister had to say:

To:  Donna Devine

Ingrid denies having any such conversation with Judge McCoyd where she tells him that he would actually like me if he knew me outside of this trial..?
July 21, 2017  2:33 pm

From:  Donna Devine

She had the conversation with me where she said she told the Judge he would like me if he knew me!
July 21, 2017  2:35 pm

To:  Donna Devine

Oh!  It's ... YOU ... he would like!  And what were you  expecting me to do with that?  I'm assuming ... NOW ... I had misunderstood the same about my probation supervisor Officer Davis and my public defender Ingrid McGaughey?!
July 21, 2017  2:45 pm

From:  Donna Devine

No she meant you that he would like!
July 21, 2017  2:46 pm

From:  Donna Devine

And also Officer Davis said he liked you !!  They don't know me at all!!!
July 21, 2017  2:48 pm

From:  Donna Devine

I just said to them you would like my brother if he wasn't in trouble!  They both said they like you now!!
July 21, 2017  2:51 pm

To:  Donna Devine

"Injustice anywhere is a threat to justice everywhere?"   Don't be surprised just how much they actually do know about my Arkansas family.
July 21, 2017  2:53 pm

To:  Donna Devine

I'm beginning to see ... NOW ... just how hopeless even our so called "Progressives" are!  What do our elected "Elitists" have in common?  They both triangulate their goo(l)d fortune off the congeniality bias (misfortune) of their constituents!  I'm a dead man.
July 21, 2017  3:03 pm

Thought I would just go ahead and put it out there.  Not expecting a reply from you to this email.

Hello Whitney,

First, just want to let you know how disappointed I was over how little was in this folder with Law Office of Public Defender Dekalb County regarding my case.  There was nothing in this folder about the first plea offer from Solicitor-General Office I rejected.  No copy of email from Weylan Getz representing DeKalb County on behalf of Solicitor-General's office.  No copies of emails from me in this folder showing my many attempts at trying to discuss my case with you.    Nothing showing any kind of research by you in preparation for my hearing except copies of DeKalb County Code Ordinances.

Nothing!

How ironic.  Doctors, that's right, even veterinarians can get sued for such poor record keeping.

Also, letting you know that the USB drive taped inside this folder was of a file labeled Terri.  Also it was a hearing presided over by Judge Mannheimer.

So...

How about just letting me know how to go about requesting copies of these hearings myself?  Also keep in mind that one of these hearings/non-hearings, "THE TRIAL!" was held at Courthouse downtown Decatur.   Will these recordings be kept at a different location than the ones held at Camp Circle Drive?

Regards,

Not Defined, Undefined, Unidentified~(8!0)~James E. Avery, D.V.M.

P.S.

Already told this to you once before but feeling the need saying it again,  "Before I'm needing worrying about Judge McCoyd final judgement, I'm needing getting pass yours first."  Never stood a chance with you assigned to me as my counsel.  And I can't help but believe that's exactly why you were assigned to me.  Even to the point of having Marian Maloney, first public defender assigned to me, abruptly rotated out to another division and you rotated in as her replacement.

Even the email sent you by Public Defender Claudia Saari hints at double- mindedness; "excellent issue to appeal" plus "hearing that you did  wonderful job representing a very challenging client".

By the way, I've sent Ms. Saari two emails regarding these "excellent issues to appeal and yet to hear from her?   Why not?

Nothing in this file...also... as to why I"m choosing not to appeal this case.

Understanding that you could release copies to me of everything but attorney generated products; honestly, finding it hard to believe you capable of generating anything!

Hey Matt,

Enjoyed our conversation as well.

I'm surprised you were still willing to accept this donation after hearing the unusually  negative reasons behind me doing so.

Anyway, $10,000.00 donation in memory of my father Charles Denson Avery, M.D.(who would not have approved) has been sent.

Let me know if this attempt  didn't get accepted either.

Sincerely yours,

James E. Avery

P.S.

THought you might find the 1987 LSU-SVM graduation pic of me with my Mother, Father, Sister, Two Niece, and Aunt Jeanette interesting.  Thought it unusual that all those on my left had or having  to work while all those on my right still do not.  LIke I told my mother and sister,  although Atheist, at least I'm able pretending that I believe in Purgatory.  In other words, we could pretend that we don't get into heaven until we get Dad through that gate first.  So I deposited the $14,000.00 gift check given to me by my mother to my account, then turned right around donating $10,000.00 of it to GIP.  Both my mother and sister are extremely unhappy about this.  They both are completely unable understanding that it's because of this money we not only let our workaholic father work himself into an early grave that making it possible for them?us not having to work,  it's also this money that's making it harder, rather impossible, getting me who really should be working off and away from this crystal meths addiction of mine.  ANd this is where our less than honorable  Judge Matthew McCoyd is proving  himself to be quite a hypocrite actually.    But apparently I've never going to be able finding anyone backing me up on this observation of mine.

"Happy people seldom concern themselves with the future."

The purpose of this email is my attempt, even should it prove itself futile as well , informing all MMCA neighbors of mine that we are not done...yet...with these hearings over the inappropriateness of these signs my property 1840 Mason Mill Road; as well as correcting some of the misinformations having read within updates posted to MMCA newsletters that were being passed along to the rest of it's hundreds of its members not having been present at these court hearings; misinformations at best... misleading; misinformations at worst... manipulative/deceptive eliminating consent.

1.  Only in jail for five days.
2.   Another court hearing scheduled Tuesday, January 31, 2017 at 2:00pm Courtroom E Camp Circle Complex.
3.  That this hearing is only Judge McCoyd wanting to clarify the terms of probation.
4.   Unless a mistake, the length of probation has been reduced from 60 months to 6 months.
5.   All probation suspension fees waived.

In need of getting this email out to our MMCA leaders (NEXTDOOR.COM's Mason Mill Neighborhood Leads) as quickly as possible as the sun will soon be rising, going to stop here and send the rest later.  However I'm feeling I must add,  these changes having occurred without any updates both MMCA's Newsletter or Bobby Rasulnia's Petition, I'm DAMNED curious hearing what Our Honorable Judge Matthew McCoyd having to say at this hearing Tuesday afternoon?   What I will be allowed (not allowed) saying at yet another hearing (non-hearing).

State of Judiciary
Chief Justice Harris Hines gave the State of the Judiciary report this week to a joint session of the House and Senate. Highlights include his review of his 16 years of service chairing the Supreme Court of Georgia’s Commission on Children. Representative Wendall Willard and I are the House appointees to this Commission which has led the state in child welfare reforms — thank you Justice Hines, who will be replaced as Chair of the Commission by Justice David Nahmias.
There are currently 139 Accountability Courts, funded as part of Governor Deal’s Criminal Justice Reform, and additional proposals are coming forth this year to reduce the number of Georgia citizens on criminal probation. Georgia has 6 times the number of citizens supervised by probation services than other states–inefficient use of tax money, that should focus on a smaller number of more dangerous offenders.

***

Copied and pasted the above information from a posting to The Cove Report by our Representative Mary Margaret Oliver.

So...what would be some possible answers to solving this inefficient use of tax money?

And even better question asking,  which one of the two groups would I now fall into:

1)  the ones having been denied probation
2)  or the smaller number of more dangerous offenders needing to be focusing our attention on instead?

Although I still consider myself a Progressive,  I'm definitely having to borrow a moniker from our Conservatives just too perfectly fitting for all these culturally arrogant Emory affiliated elitist neighbors of mine...LIBTARDS!   As it relates to the inappropriateness of signage 1840 Mason Mill Road, you are all acting like a bunch of LIBTARDS!

Mary Hinkels has closed the discussion,

Simply Jim
