Hello Donna,

You keep saying there is money in Arkansas that is mine?  That all I'm needing to do is ask mother for it..?

However,  that money is not mine until after the "gift" checks having first been accepted.  Mother will understand this.

Well I did accept the last gift check mother wrote me which I turned right around and tried donating $10,000.00 to Georgia Innocence Project at the time of THE TRIAL January 20, 2017 of which the Honorable Judge Matthew McCoyd presiding over this trial one of GIP's founding members.

Dear Mr. Avery,

I am the interim director of the Georgia Innocence Project.

Thank you very much for your very generous $10,000 donation to the GIP.  We are grateful for your interest in and support of our organization.

Matt, our recently hired Operations and Communications Manager, told me about your phone conversation with him and his promise that GIP could notify the judge in your case, Judge McCoyd, about your $10,000 contribution.

I'm afraid that Matt was mistaken, and we are unable to make good on that promise. GIP's bylaws, acceptance criteria, and policies prohibit us from getting involved in court cases or communicating to a judge or prosecutor on behalf of someone unless the person is our client. Our case acceptance criteria requires, among other things, we can only accept clients who have been convicted of a serious felony and have finished all of their direct appeals.

Because it appears that you've donated to us with the understanding that we would contact Judge McCoyd on your behalf and because we are unable to do that, we have refunded your $10,000 donation.  It will take 3 to 5 days to be fully refunded back to your credit card. We sincerely apologize for our mistake and we hope this does not inconvenience you.

Thank you again for contacting and supporting the the Georgia Innocence Project. We wish you the very best of luck on your case.

Sincerely,

Clare Gilbert

Since you and mother objected, in the name of our father who art in heaven, me donating most of this money to GIP, I wrote mother a check for the full $14,000.00 amount of this gift check I had deposited to my account.  Not for mother holding this money for me until I'm needing it but outright refusing the gift because of you two refusing to have faith in me.

Since this last hearing took an interesting turn, I'm curious enough sticking it out a little longer before giving up.  If mother willing, I will accept $1,000.00 of this money; no strings attached.  You have to understand, that when you say, "paying my bills," that my bills are different than yours.  Don't go letting the illegal part fool you into thinking it any differently.   As it's nothing more than the addiction all other addictions looking down upon, it's appearing I've learned how to loop "GOD" into a circle and hanging him from around our neck (waist?), or maybe just mine, like an albatross?

Sincerely yours,

Simply Jim

A warm embrace. A box of chocolates. A bouquet of flowers. Since these are often the small gestures many of us use to celebrate the ones we love on Valentine's Day, we wanted to send you flowers and a virtual hug.
(We thought it'd be cruel to send you a picture of a box of chocolates you can't eat.)
Thank you for your unwavering love and support as we fight to free men and women who should be embracing their loved ones today.
Sending you lots of love today and every day,

Race and Wrongful Conviction
Race discrimination undermines the reliability and integrity of the criminal justice system.

Muscogee Co. DA's Tally of Jurors in 1970's Death Case
Racism in Jury Selection
Our client Johnny Lee Gates was wrongfully convicted and sentenced to death by an all-white jury in 1977 for the murder of a young white woman in Columbus, Georgia (Muscogee County). He’s been in prison ever since, now serving Life Without Parole.
We teamed up with the Southern Center for Human Rights, a leading civil rights organization, on Johnny's case and investigated race discrimination. Court-ordered prosecutor jury selection notes prove that Muscogee County prosecutors intentionally kept qualified black jurors off of Johnny's and several other death penalty cases involving black defendants in the late 1970's.
Today, we joined SCHR in supplementing our pending Extraordinary Motion for New Trial in Johnny's case with this new incontrovertible proof of race discrimination. Systematic race discrimination in jury selection was unconstitutional in 1977, just as it is now.
For more, read our blog post Race and Wrongful Conviction, and check out Bill Rankin's article in today's Atlanta Journal Constitution.
2018 Innocence Network Conference
In a few days, GIP and several Georgia exonerees will head to the annual Innocence Network Conference, this year in Memphis, TN where civil rights legend Dr. Martin Luther King, Jr. was assassinated 50 years ago. The central theme of this year's conference is Race and Wrongful Convictions.
Did you know?
  • African Americans make up 13% of the U.S. population, but they account for62% of DNA exonerations.
  • African Americans comprise a shocking88% of DNA exonerations of people arrested as minors
  • 86% of GIP exonerees are African American.
Our Team
We know you've been waiting for it. It's finally here! Meet the staff behind the Georgia Innocence Project.
The Consequences of an All-White Jury
2012 Duke University-led study found that in cases with no black members of the jury pool, black defendants were convicted 81% of the time, while white defendants were convicted 66% of the time. When the jury pool included at least one black person, conviction rates were instead nearly identical: 71% for black defendants, 73% for whites
GIP in the Community
Clayton State University Americorps Service students recently invited GIP to speak on campus about wrongful conviction. GIP Exoneree John White and Deputy Director Grace Akan spoke about the factors leading to wrongful conviction and the impact of wrongful imprisonment long after release.
Volunteer Profile
Meagan Hurley
Meagan joined us in the summer of 2017 as an intern from Mercer Law School. When assigned the Johnny Lee Gates case, Meagan became "obsessed," vowing to fight for him until his release. Sure enough, Meagan has been incredibly tenacious in her pursuit of justice for Johnny. We are proud to have Meagan on our team!
