Finding it interesting, how  my response to Lauren's request that I stop sharing with others any communications between me and the Law Office of the Public Defender, just about the exact same as my last words to you before the two of us parting ways;  our meeting brought to an end due to you needing to be in court.

Something telling me, intuition maybe, or would this be the sixth sense, that you were going to be making this request of me?  Maybe why I brought up the article about "The Sentencing of Willie F."






Anyway, the above link will take you to the blog article where I've uploaded the recording of what was mostly just another monologue rant by me as usual;  nothing said that I prefer for others not knowing; even the fact of having a crystal meths addiction which has relapsed back into  being a daily habit again going on three years now.    As I have been open and honest about everything,  I'm certain of it, it's not me who's not doing the right thing where it relates to the inappropriate signage 1840 Mason Mill Road and even the meths addiction.

This is Marian Maloney, your Public Defender. I just wanted to follow up with you about what happened in court this afternoon. I know that we stayed after to discuss what had transpired, but since you were having some difficulty hearing, here is a short synopsis:

1. Your case has been specially set for trial on September 13, 2016 at 2 pm. You and I will meet before then; I will be in touch later about a good time when we can meet to go over everything for your case.

2. The County, through its prosecutor, made a motion asking the judge to issue a cease and desist. I opposed the motion, arguing that you are innocent until proven guilty. Judge would not grant the County's motion; however, Judge made clear that if you are not in compliance with the code sections, that you are exposing yourself to having more tickets issued to you for every day that you are in violation. Below are the specific code sections for which they have written you citations so that you know what the code sections say.

Citations allege violations of code sections: 21-13, 27-1583 (A)(2), 27-1584(C)(1)

Sec. 21-13. - Restrictions in residential zoning districts.
The following regulations shall pertain to lots located in single family residential zoning districts and R-DT, TND, RA5, RA8, RCH, MHP, NCD and RM zoning districts:
(1)
Lots used for residential purposes other than for apartments, condominium, mobile home, or townhouse developments shall not have an aggregate sign area greater than twenty-four (24) square feet per lot. Flags and banners shall not be included in the calculation of aggregate sign area. Subdivision and entrance signs shall not be included in the calculation of aggregate sign area;

Sec. 27-1583. - Temporary outdoor seasonal activities.
Temporary outdoor seasonal activities include the sale of retail merchandise associated only with recognized seasonal and federal holidays, the sale of farm produce, Mother's Day, Easter, and Valentine's Day, subject to the following regulations:
(a)
Use regulations.
(1)
A special administrative permit shall be required, for all temporary outdoor seasonal activities.
(2)
Events or sales of retail merchandise not customarily associated with seasonal or federal holidays or farm produce is prohibited.



Sec. 27-1584. - Temporary outdoor retail sales displays.
Temporary outdoor retail sales displays and related outdoor storage activities include the exhibition or representation of goods, merchandise, materials, or other items sold or bought at a retail establishment in which the items are displayed or sold outside the confines of a wholly enclosed building, and which are associated with the principal use of an existing business. Temporary outdoor retail sales displays shall not include events for which no business license is required (e.g. cookie sales). Temporary outdoor retail sales displays shall be subject to the following regulations.
(c)
Setback and display requirements.
(1)
All temporary outdoor retail sales display activities, including installation or erection of associated temporary display and sales structures, and stand-alone merchandise, display tables, or display racks, must be set back at least ten (10) feet from a county or state right-of-way.

Just concerned that I have not heard from you yet about a possible date for us going over my case..?  

I do not remember if we had discussed any part of my pretrial conversation with Solicitor Graham that led to her informing Judge McCord that she was uncomfortable proceeding forward with the court hearing. 

As I am already isolated due to a hearing impairment and losing even more as I age...

As I have recently become even more isolated due to having lost most of my vision my right eye with a 15% chance same happening with other eye...

It's important that you understand why any outcome involving any kind of probation in addition, or not, to a fine is unacceptable to me.


And this is going to require a decent amount of time.

p.s.  DeKalb County Mobile Crisis Unit has paid me another visit this passed Monday.  This makes the ninth time they have come out to my house uninvited, unannounced, unwelcomed as they are a complete waste of both our times.  I've even been unable getting copies of any of  these records/reports associated with these visits because they...supposedly... are not considered legit medical records.  Considering it was at the end of the third visit that a Chemical Nurse Specialist Lana Chase informed me of the reason for these visits being a concern that I might be a homicidal/suicidal risk, maybe you will be able understanding why I have now ingrained the... potential... for a suicide into my story?  

I'm not saying that I plan on hanging myself, only that I'm now able understanding why someone would.

I received your email that you sent late Sunday night. I apologize that it has been two weeks since we last spoke.

I wanted to give you a few updates. First, the prosecutor who was prosecuting your case is no longer working with the DeKalb County Solicitor's Office. A different prosecutor will be taking over your case. The County is still intending to go forward with trial on September 13th.

Before today, the judge had also not actually completed an order appointing me to be your attorney. He has finished that paperwork today. If you recall, he said in court that he was appointing me due to some concerns he had about your mental health and competency to understand the court proceedings after the prosecutor herself had raised some concerns. He has told both myself and the county prosecutors that if he decides that he wants a formal evaluation completed, that he will let all parties know by this Friday. He also wants any motions, if there are any, filed by next Friday, the 9th.

You might also recall that Judge McCoyd had some concerns about whether you could adequately hear what was going on in the courtroom. He's indicated that he will likely be moving your September 13th hearing to the downtown Decatur courthouse where he suspects they have hearing assistance devices. Myself and other folks within my office are working to make sure that you'll be able to hear the proceedings wherever they end up being. I will let you know for sure which location we will be at on the 13th.

As far as meeting to discuss your defense, what is your availability for next week?

Curious now as to who will be paying for this "formal" mental health evaluation?  Far as I know, Georgia Regional Hospital still has a lien against my home for when I was involuntarily committed (with the help of my Arkansan mother and sister) for five weeks back in August/September of 2011?  In addition to these nine unannounced/unwelcomed visits, so far, to my home by DeKalb County's Mobile Crisis Unit,  are we possibly admitting these evaluations to be flawed/inadequate?  I'm still extremely unhappy with how DeKalb County (most especially Emory) having taken advantage of a self-avowed practicing homosexual's complicated relationship between him and his eighty year old rural Arkansan mother. 

"OH NO!  We didn't...GO...to California; just San Francisco!"

It didn't help any, either, that all my mother had to do accomplishing this, was, getting my big sister of seven years to stop playing tennis long enough driving her across several states to Atlanta.

Also, would it be possible having this "formal" mental evaluation performed at Care and Counseling Center of Georgia?  It's just down the street from my house.  Plus, there definitely should be less history needed bringing them up to date about my situation.  In fact, possible we may even be able skipping S.ubjective O.bjective going straight to A.ccessment; maybe even straight to P.lan?

Not only should this save the State of Georgia some money; even willing paying for it out of my own pockets..

I'm serious about this.

I apologize in the delay in getting back to you.
I've been out of town for a work conference.
I will check in with Judge McCoyd this week to see where your eval referral is in this process.
I will email you back once I receive an answer from him.

To address your other questions:

1. it is my understanding that once an evaluation has been scheduled, it is performed at the Public Defender's Office. So you may need to come to our main office located at 320 Church Street in downtown Decatur. I will ask if the interview can be conducted at Care and Counseling Center of Georgia, but I am uncertain if that is a possibility. Do you currently receive treatment there?

2. In terms of payment, I believe that since the Judge is requesting it, the evaluation is paid for by the state.

3. Ordinarily the cost for the services of the Public Defender would be your obligation. However, I believe that the Judge appointed us to your case, is that correct? If so, then I would certainly request that the $50 application fee (which would be your only costs for our services) be waived. I would make that request at the conclusion of your case, whenever that may be.

Thank you for getting back to me.

How is it decided...WHO...will be doing this evaluation?  

As my signs have a strong religious theme to them,  I am mainly interested in Care and Counseling Center of Georgia because it's actually "Pastoral" Care and Counseling Center of Georgia. Remember the eighty-five year old black man with a blower on top of the house directly across the street from my house I had mentioned to you during our phone conversation?  I spent 2 1/2 weeks in DeKalb County Jail all because of an email not only nothing but words but words to be true having violated a restraining order the owners of that house had against me.

As far as where the evaluation takes place, Public Defender's Office is fine with me. Fifty dollar application fee is no problem for me as well.

Hello Mrs. Gibbs,

Received three more citations from Officer Housworth, accompanied by Officer Flemmings,  this afternoon.  Believe this now makes for a total of seventeen citations.   

However, one of these three citations is for having seventeen signs over the four I'm allowed when assuming each sign is six square feet which is the maximum sign size allowed in residential neighborhoods.  Officer Housworth didn't seem to know for sure whether this counts as just one citation or seventeen citations?

No updates on status of this mental evaluation..?

Theft of five more signs and second set of socks monkeys from my front yard broad daylight this past Friday afternoon on a street which is usually pretty busy with traffic due to being a major artery onto and off near-by Emory campus..?

Another court hearing for latest set of citations scheduled for this coming November 1st, 2016..?

Is it safe for me not showing up for this court hearing as well?

Also, is it possible for us meeting in person discussing my case as we wait for further instruction regarding this mental evaluation?  I'm wanting to hear what thoughts you are having about my case so far?  More about this plea bargaining with the Solicitor General's office you mentioned in your last email to me?

p.s.:  Are you aware of any police reports filed against me as of late?  Received an email (from someone I do not know) suggesting there had been some filed against me..?  Even talks of plans having me involuntarily committed..?  At the moment I'm just laughing them off.  Should I not be?  

Oh!  Listen to this! 

The other day an old man stops his car in front of my house as I was putting out my signs for the day and says to me:  "What you do with those other people I do not care; that's your business.  But why drag the Jews into this?  What they have to do with any of this!"

Standing in the street beside his car, I said to him:  "Those...SIGNS... are their opinions.  Those ...SIGNS... are my attempts trying to show you the difference between...THEIR...signs and...MINE."

And this is where he angrily mumbles something, something I could not make out but fairly certain others probably could have, as he begins driving off.

This act having set off multiple triggers, I yelled after him:  "IT'S NOT YOUR LAND!  YOU MIGHT AS WELL SHOVE THAT THOUGHT UP YOUR CHOSEN ASS!" 

The next day as I'm politicking from sidewalk front of my home, I'd managed baiting into a brief discussion, about my signs, two women as they were walking through my property on this sidewalk.  Although not recognizing either of these two women as any living Mason MIll  neighborhood, assuming they were Mason Mill neighbors of mine, I said to them:  "Those signs of mine with people holding signs are my attempts showing the difference between their signs from mine."

Then I pointed to a signs close to where we were standing that reads, EVERYONE NEEDS A CHURCH:  LETS CARPOOL, accompanied with a picture of Earth wrapped up in barbwire.    

"This sign for example!  The neighborhood I'm wanting to believe I live in extends halfway around the world in all four directions to a same point located somewhere in the Indian Ocean.  We are already carpooling!  A person who thinks like this is going to think differently from a person just thinking of Mason Mill as his/her neighborhood." 

"One sign up there was really offensive!" said one of these two ladies as she points in the direction of signs place near sidewalk other side of my property from where we were standing.

"Oh really!  Which one?" I asked.

"The one that says, 'GOD HATES JEWS.'"

"What about the one that says,'GOD HATES FAGS,'" I then asked?  "It's possible to be both you know?"

These two then appearing to have nothing more to say, I followed up with, "Not only am I gay, I'm Atheist as well.  I've been doing this too long for this neighborhood to have no good excuse for not already knowing this."

P.S.  Would it be wrong of me asking why Marian Maloney was abruptly rotated out to another division and you rotated in as her replacement?  Also curious as to why Stephanie Graham no longer with the DeKalb County Office of Solicitor-General?  Genuinely believe I should have a right knowing the reasons for these changes as these departures cheats me out of any conversation(s) having had with these two; most especially the two hallway pre-trial hearings with Stephanie Graham.  There's a calculated reason behind everything I say.  Or attempt to say.
